Gun trust. Do you have one?

I?m looking for advice from anybody that has a gun trust. I?m seriously thinking of getting one. I?m not getting any younger and I don?t want to burden my family members if something were to happen to me. I do not have any title 2 firearms. I do, however have a few RAWs.

If you have one, where did you get it? What was involved and what was the cost?

      FYI.

      Under CA laws...

Registration of a RAW is limited to an individual. [PC 16970(b)]

Which means a Trust cannot take legal ownership/control over a RAW.

The Executor of the Deceased's Estate or the surviving spouse can legally take possession of the deceased's RAW and dispose of it within 90 days of taking possession of it. [PC 30915]
^Possession after the 90 day window, in CA, equates to illegal possession of an assault weapon. [PC 30605(a)]

So I guess a gun trust is really only necessary. If you have firearms that are usually only available outside California. A standard trust will suffice for most firearms.

I personally will never list any of my personal firearms in any kind of will, trust, or any other document that I can avoid. My kids and other family already have a plan for all that stuff, and it does not include government agents. To each their own. YMMV.

My understanding is that they are best for tax stamp items like suppressors and such. To make it so you can pass them on down to family members that are a part of the trust. Since we cannot have suppressors in this state not so much use for a trust.

A trust is like a person to the law. Even if kali said a trust is like a person, you would have to transfer ownership of your RAWs to the trust, and you can't transfer RAWs.

Leave instructions for your next of kin to contact LSB and arrange to pickup your collection. I plan to do that for my estate planning.

What do you intend to accomplish with the trust? What function do you believe it will serve with respect to your guns and your RAWs in particular?

When you say RAW, BP are you referencing firearm(s) that are on the 'banned' list? Or are they firearms that have 'features' that made them AW's that you did not wish to de-feature?

If any of them are not on the list of banned AW's, I'm pretty sure you can de-feature (add grip fin, get rid of flash hider, remove bullet-button, etc.) and then de-register from being an RAW. If any/all are on the list, they will have to be sold to out-of-state buyers or maybe there was an unfortunate boating accident?

Would a trust work if the firearms are out of state?

My young daughters already argue over who gets what.
My wife is onboard with our gear. My family is my Trust.
                          Maybe a buddy or 2.

This is NOT legal advice. You are NOT my client. This is simply an observation based on experience. If your offspring are now fighting over who gets what, you have a serious problem that will only get worse after you die. If you love your daughters deal with those issues now before they get worse. There are people who can help you. Seek them out.
