How do out of state gun sales work?

I have never sold or bought a gun other then FTF. If someone out of state wants to buy a gun from me what is the payment method used to ensure I don't get screwed?

Do they pay up front always? or does the FFL get the cash then you ship then FFL send cash to me?

if someone wants to buy a firearm from you and you are in CA while they are out of state, they need to send you the funds and the out-of-state FFL's info that they want to use. They will either give you a copy of the FFL license, or just the FFL license number. YOu then go to the ATF EZ-check website, https://www.atfonline.gov/fflezcheck/ , type in the number and confirm that the FFL is valid and only ship to the confirmed address.

You then box up the firearm and ship it to the FFL. If a long gun, you can use USPS, UPS, Fedex, etc. If a handgun, you can't mail it USPS, but must use UPS, Fedex, etc. Since you are shipping it to an FFL, you are not required to inform the shipper that the package contains a firearm, but if you don't, UPS/Fedex may not pay the insurance if you ship in violation of their company rules.



If you happen to be out-of-state and happen to find a buyer, you would need to go to the buyer's FFL to have the FFL facilitate the transfer to the buyer.

If the firearm happens to be a handgun, there is a No Longer In Possession form that you can send to CADOJ to have them update the handgun registration records to note the sale to an out-of-state buyer.

accpet payment thru usps money order. you can goto the postal office and cash it.

Incorrect. Neither CA nor Federal law require you to use an FFL to ship a firearm (except for registered Assualt weapons). Some FFLs have a company policy to only accept shipments from other FFLs, but that is a person policy not backed up by law.

i thought handguns have to be shipped from FFL to FFL regardless of it is interstate or from different state. a person can ship a rifle within the same state, but out of state requires FFL to ship to a FFL.

nope. Federal law allows for a non-licensee to interstate ship a firearm to an FFL of any state. For intrastate shipments, federal law does not even come up.

And CA law does not require shipments to come from an FFL either.

Now, if you want to mail a handgun via USPS, that is only FFL to FFL, but you don't have to an FFL to ship a handgun via a common carrier such as UPS or Fedex.
