    Rad Flag Laws

    Pretty unreal to see Cali?s Red flag laws happen to someone you know. A verbal altercation where the opposite party falsely claims a gun was involved turns into guilty until proven innocent just like that. Confiscated firearms, Gun restraining orders, bail money, lawyers fees, all from hearsay, zero proof and the accused spends thousands to defend themselves.

    The less people know about your guns the better. Like the good ole days, tip a hat, agree to disagree and say good day sir. I witnessed a shouting match between two neighbors from the beginning the other day, man vs woman. A 4th neighbor had to come out and calm things down with a hug to the woman. I think he realized there was no winning this one and stopped talking. I said nothing and was grey.

        When I was in CA I loaded them into the car while in the garage.

        If moving, I put them in those large black plastic trash bags when carrying them to my car in the open.

        Even though no red flag laws way back then.

          That suuuuucks!

          So how did this go down? I mean, was this a neighbor dispute and the neighbor went in and called the cops saying your friend threatened him with a gun or something? Or was your friend CCW'ing and got into an argument with some stranger who then accused him of pulling a gun?

          I'm trying to understand why he was red flagged and not actually arrested for threatening the dude.

          I'm also wondering why nobody has challenged this yet. Red flag laws are clearly unconstitutional and seems like they're ripe for someone challenging them...especially if they're falsely accused.

            That doesn't sound like "red flag law". It doesn't even sound like a civil harassment restraining order: those you can defend against yourself if they are unsubstantiated, and you said "thousands to defend". Given that you said "bail money", it is more likely an actual arrest.

            There is probably much more to the story.

              That's just one of the problems with the red flag laws - the threshold is way lower than any potential criminal activity. Threatening someone with a gun is at least a defined offense. Red flag is literally to allow hearsay to switch the presumption of innocence.

              We have to clean up "carry" and AWB-s first, red flag laws will be next. They are a travesty.

                No ccw, no firearm anywhere near the incident. Total fabricated lie, they got into an argument, guy made up a huge story saying he was waving a gun around saying white people are the only ones that belong on the mountain where they live. Completely insane response to someone asking you to slow down and not tailgate every neighbor on the road. Rural setting so a helicopter was deployed. Doesn?t matter if you?re falsely accused, if someone says you pulled a gun, your rights go out the window.

                  This is crap. If he was waving a gun around then he should have been arrested/cited and charged with brandishing. And if there is no evidence to do that, then they damn sure shouldn't be taking his guns. Red flag laws are such crap.

                      Yup. The criminals aren't following the law.

                        Exactly! And it's not a bug, it's a feature. Don't even get me started on DV misdemeanors - it's designed to make gun ownership a minefield.

                          I recall reading bout this here a while back. The person being accused should plan on playing the long game. Get CRPA and NRA involved, sue the state for the laws, local law enforcement and the person accusing them.

                          Start a fund to do all of the above, many people will help to contribute to this. Once the person making the accusation feels pain and the local law enforcement as well for enforcing false charges they will think twice about doing this. In the end all legal gun owners benefit.
