    Arizona CCW Fingerprints, CA COE

    Does anyone know what happens to your fingerprints after approved for a CCW? For renewals you don't need to be fingerprinted again, so I'm guessing they're stored? I'm just wondering because I was told for arrests there are now strict federal laws pertaining to this, typically cannot keep fingerprints or DNA samples more than 3-5 years if not convicted, but can be less depending on the charges filed. I'm not sure if for licensing purposes this applies as well?
    On that note, what happens to fingerprints submitted to the CA DOJ for a certificate of eligibility?

    Maybe they keep them so they can do another background check without requesting new fingerprints

    That would seem logical and reasonable to me

      An FBI # is generated when you print for a stock broker, insurance agent and CHL.

      Prints are in the system. If arrested they get notified.

      Renewal, they run a background check again


      Easy
      Rule 1- ALL GUNS ARE ALWAYS LOADED

      Rule 2 -NEVER LET THE MUZZLE COVER ANYTHING YOU ARE NOT PREPARED TO DESTROY (including your hands and legs)

      Rule 3 -KEEP YOUR FINGER OFF THE TRIGGER UNTIL YOUR SIGHTS ARE ON THE TARGET

      Rule 4 -BE SURE OF YOUR TARGET AND WHAT IS BEYOND IT

          For how long do they keep them, indefinitely? Someone mentioned that in 2013 laws were reformed and fingerprints now can't be kept for more than 5 years?

              Public Law 92-544. Specifically, this PIA addresses the retention and searching of civil fingerprints submitted by federal agencies, except when expressly precluded by federal law, and the retention and searching of civil fingerprints submitted by state, local, and tribal agencies, when retention is legally permissible and selected by that agency.

                Off-topic: Back in the 70's, my high school buddies were concerned about the FBI nosing around and starting files on them for various activities. It turns out that you can request from them whether or not there is a file on you. Downside was that if there wasn't, there was a good chance they'd start one. At least that was one of the many rumors going around at the time.

                      Per FBI...
                      Live scanned fingerprints sent for non-criminal investigations must be deleted from the live scan system within 24 hours of receiving the results of the fingerprint search.
                      ^This is the new post-2020 FBI requirement.

                      Per CA DOJ...
                      Live scanned fingerprints sent for non-criminal investigations are automatically deleted from their system, via the software that manages their system, 60 days from when they are submitted.
                      ^This met the old pre-2021 FBI requirement.


                      Regarding CA CCW renewals...

                      Legally, fingerprints are not required for a renewal of a CA CCW permit. [PC 26185(c)]

                      However, there is currently a bill [SB918] in the CA legislature that will amend existing CA laws and require fingerprints for renewal applications.

                      CA DOJ is required to notify an issuing agency when a permit holder becomes a prohibited person so that the issuing agency can immediately revoke that permit holder's permit. [PC 26195(b)(2)]
                      ^This why fingerprints are not required for CA CCW permit renewals.

                        Just sent in my AZ renewal paperwork (first time for a renewal). No mention of fingerprint requirements on the renewal.

                          Or will they require the CCW holder to pay and submit again, increasing the already ridiculous fees for CCW?

                            In the proposed legislation, fingerprints/live scan is supposed to be done every time an application is submitted, new or renewal does not matter. There are no provisions for retention of the fingerprints/live scan for future references.

                            I believe the intent for this proposed requirement is to just increase the fees associated with maintaining a CA CCW permits.
