Second Amendment Sanctuary Reviewed: Every U.S. State and County

Given the thread I posted in relation to what friends tell me is going on in Shasta County, I was doing a little poking around and found this site...

Second Amendment Sanctuary Reviewed: Every U.S. State and County

...In this article, we take a close look at Second Amendment sanctuary policies and the origin of the term itself. We also examine which counties and states have Second Amendment sanctuary policies in place, which federal firearm regulations Second Amendment sanctuary policies work to curtail, and the countermeasures being taken by anti-Second Amendment sanctuary groups...
It looks like Siskiyou County is the only one in California that doesn't look as though the blood has been drained away. (It's the color scheme they're using on the maps. But, it does seem to fit. )

I don't know how up-to-date the page is or if they even try to keep it such; but, if nothing else, it might make an interesting tidbit for the "Where to move to?" threads.

Interesting how many counties in OR have declared but none in WA and next to none in CA. That whole state is really held hostage by Portland and their whacko voters.

I'm surprised Mississippi and Alabama aren't statewide.

The concept of "sanctuary state" is only as valid as the last election. For example, Arizona has a Second Amendment sanctuary law. But now that we have an anti-gun leftist governor, you can be 100% sure that if the feds come asking, the state will be bent over to give the feds whatever they want.

As I've noted in other threads, it's more a political statement than effective law. But, it's a statement that still, sometimes, needs to be made.

Future of Second Amendment Sanctuaries unclear after the Oregon Court of Appeals invalidates Columbia County's ordinance

...The appeals court on Feb. 15 ruled the state law preempts the Columbia County "Second Amendment Sanctuary Ordinance" and so it cannot be enforced.

The court determined the county's ordinance would effectively create "a patchwork quilt" of firearms laws across the state, rendering state laws ineffective. The ordinance was legally void because of a state law that says the power to regulate firearms "is vested solely in the Legislative Assembly," aside from a few regulations explicitly permitted by state statute, the appeals court determined...

Twenty-six of Oregon's 36 counties have passed Second Amendment sanctuary ordinances or resolutions against enforcing state gun control laws. The only one of eight Eastern Oregon counties without such an ordinance or resolution is Morrow, however Lexington is a sanctuary city.

In Central Oregon, Deschutes, Wasco, Gilliam and Hood River counties have not passed Second Amendment motions. In Western Oregon, Clatsop, Washington, Multnomah, Lincoln and Benton counties have not.

Umatilla County commissioners did not designate it a Second Amendment sanctuary, but voters passed a referendum to that effect in 2020. Cities in the county were thus spared consideration of sanctuary status.

The Columbia County ruling could set a national precedent, as the first such ruling handed down at the appellate level. While the verdict applies only within Oregon, it could affect the more than 1,900 counties nationwide that have declared themselves gun sanctuaries. That's about 59%, down from 61% in 2021...

Siskiyou county has die hard, old timer, country blood and some good ol boys running Yreka. They also have an influx of Hmong pot growers.....the two sides both want their guns and freedom. Having worked in that county I have seen it first hand.

U.S. judge rules Missouri state gun law is unconstitutional

A Missouri state law that declared several federal gun laws "invalid" is unconstitutional, a U.S. federal judge ruled on Tuesday, handing the U.S. Justice Department a victory in its bid to get the law tossed out...

U.S. District Judge Brian Wimes in Jefferson City, Missouri, said the state's Second Amendment Preservation Act (SAPA) violates the U.S. Constitution's Supremacy Clause, which holds that federal laws take priority over conflicting state laws.

Wimes, an appointee of former President Barack Obama, in a siding with Democratic President Joe Biden's administration called the practical effects of the Republican-led state's law "counterintuitive to its stated purpose."...
US judge strikes down Missouri gun law as unconstitutional

...U.S. District Judge Brian Wimes ruled the 2021 law is preempted by the federal government under the U.S. Constitution?s supremacy clause.

?At best, this statute causes confusion among state law enforcement officials who are deputized for federal task force operations, and at worst, is unconstitutional on its face,? Wimes wrote.

Missouri?s Republican Attorney General Andrew Bailey in a statement said he will appeal the ruling.

?As Attorney General, I will protect the Constitution, which includes defending Missourians? fundamental right to bear arms,? Bailey said. ?We are prepared to defend this statute to the highest court, and we anticipate a better result at the Eighth Circuit.?...

Republican lawmakers who helped pass the bill said they were motivated by the potential for new gun restrictions under Democratic President Joe Biden, who signed the most sweeping gun violence bill in decades last year...
The bill in question is H.B. 85.

So that means illegal alien sanctuary states are also unconstitutional. All those state laws should fall. Same with the legalization of marijuana laws.

It looks like only Idaho now meets the "Gold Standard" in the GOA map in the previous post.

See 3/9/23 updates (Posts #24 & #25) in this thread... Missouri: "Second Amendment Preservation Act". Is it a way to go?

Gold - The "Gold" Standard of a Second Amendment Preservation Act (SAPA) offers Essential Protection for gun owners against gun control that is contrary to the U.S. Constitution or the Constitution of the State in question. Gold Standard SAPAs must include protections like the prohibition of funding for gun control and/or criminal or civil penalties for government agents and/or agencies that enforce unconstitutional gun control. States that have passed measures meeting the "Gold" standard are Idaho and Missouri.
