Hypothetical question here. I have no intention of attempting anything illegal. Just a thought last night regarding intrafamilial transfer of off roster guns from out of state. Not withstanding any felonies committed at the State or Federal level, how would CA know if your "daughter" sent you a firearm from out of state? If she had married and changed her name, or son never took your last name, etc. Is the relationship established other than by the form and ID sent with the weapon?

Your filling out the forms is creating a paper trail to snag you later if you and your transferred firearm come to the attention of the authorities.
I'd not recommend anyone take advantage of this.Comment

Because the transfer is between residents of different States, Federal laws requires the transfer to be done through a FFL dealer. [18 USC 922(a)(3),(5)]Hypothetical question here. There is no intra-familial exemption to the Federal laws.
Failure to utilize a FFL equates to a Federal felony for everyone involved with the transfer. [18 USC 924(a)(1)(D)]
Since the firearm is being transferred to a CA resident, it must be done through a CA FFL dealer.
In order to be processed as an exempt out-of-state intra-familial transfer, in addition to a copy of their valid State DL/ID, the out-of-state immediate family member must also include a gift letter that indicates the relationship of those involved and the firearm(s) that are being gifted. Which the CA FFL dealer will retain for their records, which can be accessed by CA DOJ BOF when they audit the CA FFL dealer.
No gift letter could result in the CA FFL dealer being fined or closed down for improperly processing a firearm transfer.
In addition, if CA DOJ determines that the off-Roster handgun did not qualify for any exemptions to be transferred, then the transferee will also be contacted by CA DOJ BOF and requested to exchange the off-Roster handgun for an on-Roster handgun or, if the off-Roster handgun was not CA legal, surrender it for destruction.Last edited by Quiet; 02-22-2023, 4:03 PM.sigpic
