Shipping problem from out of state....

ARGH MORE WAITING TIME!! Currently buying a Stag AR from Atlanta Georgia from a buddy of mine.

I was under the impression that if you are purchasing a rifle from out of state, the seller only needs to send directly to my FFL of choice with proper paperwork.

So my friend goes to UPS to ship it out, tells them its a firearm *stupid mistake* and they tell him NOOOO, we cant ship it, you need to have a FFL in georgia ship it!

So i told him to take it back to UPS, USPS, or FEDEX and tell them its NOT a gun, but gun PARTS. in truth it is not a complete rifle, its ONLY the lower reciever and upper reciever, no mags, no grips, no stock.

He was thinking about labeling it as "golf clubs" but i dont want the package to get seized.

    Thanks in advance.

If he is trying to send it from a UPS Store (privately owned), they won't accept it. If he went directly to a UPS hub, he needs to tell them to read their own rules.

You can legally ship a long gun via USPS, as well.

Also claiming it is just "parts" is not right - the receiver is legally the firearm and must be treated as such, even if it is not assembled in a state to chamber and fire ammunition.

I was always under the impression that only an FFL can use the postal service for firearms. . . I forgot where I read that, though...

Anybody can send long guns via USPS. Only FFLs (does not include C&R FFLs) can send handguns via USPS.

Do you want an AOW or C&R SBS/SBR in CA?

Do your UPS shipping online and no one will ever ask you what's in the box. Just insure it for the right amount. While technically UPS's rules state that you have to declare firearms when shipping them, the reality is that it just creates a reason for the person behind the counter to freak out. It doesn't change the way they handle the item anyway.

The only special handling I've encountered with online shipping is for high-value items (based on the amount you insure it for). In those cases it has to go to a Customer Center (not a UPS store) and the rep there has to sign a special form.

I thought you could only legally send it out of state if you mailed it to your self, if you are not an FFL.

that would be incorrect. federal law allowfor a non-licensee to ship to a licensee (FFL) in any state, allows for you to mail to yourself, and allows you to ship to a non-licensee of another state for inheritance purposes (IIRC on that last one).

                          ke6guj,

I knew about the sending it to an FFL, but I was speaking of sending it to a private person not of inheritance.

I've only had one experience with a UPS insurance claim and it went well.

Our company purchased a used instrument and required the seller to get $25,000 insurance on it. Good thing because it arrived in pieces. Claims adjuster came in and inspected the package and took some pictures. We had the instrument fully repaired and UPS covered it without question.

Sorry that your experience wasn't good.
