Where to get firearms liability insurance

As you all know, there is a January 1, 2023 deadline to get firearms liability insurance in San Jose. Does anyone know where get it? What insurance companies?

I would completely ignore, but that’s my opinion.

According to the article back in May I think, the plan is to have CA DOJ send letters to all San Jose gun owners telling them how to proceed. I don’t know anyone that sells insurance that will cover you stolen firearm.

I would too, but I dont want to pay the fines if I ever get caught:
"The city will charge $250 dollars for a first offense, $500 for the second, and $1,000 for third offense within a year"

My suggestion would be to check with the places that insure CCW holders like USCCA or NRA since they are already providing firearm related issues. I use Second Call Defense for my CCW.

And how would they collect? I cannot see a legal way for them to cite you on anything, don't the bastards win. Carry on about your life I know I would. Good luck in your fight.

Insurance required. A person who resides in the City and owns or possesses a Firearm in the City shall obtain and continuously maintain in full force and effect a homeowner’s, renter’s or gun liability insurance policy from an admitted insurer or insurer as defined by the California Insurance Code, specifically covering losses or damages resulting from any accidental use of the Firearm, including but not limited to death, injury or property damage.
I would start by asking your home insurer if your current policy provides liability coverage for, "accidental use of a firearm." If they don't, then start checking the CCW providers, CCW Safe, USCCA, etc., and see if their policies have a provision for liability insurance or are they just insurance to cover legal fees.

BUT...I suspect a policy like this...if such a thing even exists...will cost more than initial fine amount of $250. That tells me...at least from a purely financial standpoint...it would be more cost effective to go without it. If you get caught, your first fine is only $250 which you would have likely paid for a single year's insurance. Odds are they aren't going to catch you the first year...or at all.

Further, if you ever get asked...I would simply say you have liability insurance through your home owners policy. Let them come back and tell you that your particular home owners policy doesn't actually cover this type of thing. Then simply say, "Oh, sorry. It provide liability coverage so I assumed it did. My bad."

I very highly suspect an injunction will be filed against this nonsense in the wee hours of January 1, 2023 (or first business day thereafter) and it will be dead-on-arrival, duly sorted, and never revived.

If some level of government had that information, what would they do with it? How would having that info benefit public safety? How would it benefit law enforcement?

USCCA is a scam. If you were forced to do insurance and if they offered something DIRT cheap...then yes I would use them, but for any ACTUAL coverage, then no.

"Firearm liability insurance" is an overbroad category and can mean anything. If you're just looking to satisfy a local law, you have to find out what needs to be covered and how much per occurrence, which must be stated in the law. Based on that, maybe your other policies already cover it, or maybe there isn't such a product available at all.

Personally, I wouldn't do it and would let the city try to enforce it. Compliance with this law is likely to be in the low single digits, if that. It will be similar to the LA ban on *possession* of some magazines where not a single one was turned into the police, IIRC. Trying to enforce these laws will lead to relatively quick court battles where the law will be stricken down. That's how I see it and how I would proceed, but by no means is that something that someone anonymous on the Internet should be deciding for others.

Looking T the gun liability insurance attestation form on the city’s website… insurance company name, address, phone number, and policy number. Are the police gonna call and verify your insurance policy? Do they need a warrant for that?

Nope, if you provide information freely, they don't need a warrant.
