    Question on mag fed SKS

    Is it legal to own an SKS which is capable of accepting a detachable magazine in CA? If not, would it be legal if restored to its original configuration?

    An SKS with a detachable mag is an assualt weapon, which is illegal. I don't know if people could register them to keep them that way. I'm sure someone can answer soon.

      SKS with detachable magazine = assault weapon [PC 12276(a)(11)].

      However, there are some CA legal SKS patterned rifles that can take detachable magazines, but those rifles need to be configured so they are not considered assault weapons [PC 12276.1(a)(1),(2),&(3)].




      Penal Code 12276
      As used in this chapter, "assault weapon" shall mean the following designated semiautomatic firearms:
      (a) All of the following specified rifles:
      (11) SKS with detachable magazine.

      Penal Code 12276.1
      (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
      (1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
      (A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
      (B) A thumbhole stock.
      (C) A folding or telescoping stock.
      (D) A grenade launcher or flare launcher.
      (E) A flash suppressor.
      (F) A forward pistol grip.
      (2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
      (3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.

        The M59/66 is not an SKS and so therefore technically would be legal with det. mags. Don't know if most leos would know that tho
