    Multiple state gun purchase question

    Hopping someone can answer a question for me. I have residence in California still and I work in California so I pay taxes there. I also have a residence in North Carolina where I own a home, have a car registered to me and spend 50 percent of my time.

    I would like to apply for NC drivers license so I can purchase off roster handguns and KEEP them in North Carolina. I have no intention of bringing them back to CA. I realize that this will require me to relinquish my CA drivers license.

    1) Can i just apply for a CA Real ID to keep my California CCW?
    2) Can I drive in CA with a NC drivers license?

    1) Depends on your IA but most likely giving up your CA DL may show that you intend to be a resident of NC.
    2) Yes.

    Why don’t you get a NC ID and buy firearms using that as ID for NC and keep them at that residence?

      If you are a California Resident (Need to be for a CCW), you have to have a California Drivers license within 10 days.

      One of the rules for California Residency:
      You have claimed residency to obtain a license, privilege, or other benefit that non-residents cannot obtain.

          North Carolina ID card. Keep your California Driver's License to maintain your CCW. Keep the North Carolina firearms purchased in North Carolina, bringing them here is a felony as of 2015.

                  What some people will do just to have an off-roster gun(s).

                  What you are considering is playing with fire.

                  50% in NC? That is highly unlikely. If it became an issue it would be very difficult to prove you spend 50% of your time in NC. It's more likely you are estimating the time spent there and when it comes to residency, taxes and gun laws, estimations are not your friends. Under certain circumstances you could find yourself with both states your adversary and neither of them willing to help you and both taking turns fleecing you at the very least.

                  If you are in NC for more than183 days they want income tax. NC also says that even if you are out of the state for more than that number of days that doesn't mean you aren't a resident there. It won't make a difference if you pay California income tax. Better seek professional legal advice for what you are trying to do and don't consider anything here to be that, it is not.

                  You are making absolutely certain you're spending exactly 50% of your time living in NC? Quite a feat considering travel times and such. However, if you do manage to spend 50% of your time there and for any reason NC decides you are a resident there and they want back taxes you're in a world of hurt. Just the legal fees are going to make any guns you bought very expensive.

                  On the driving in Ca with a NC DrLic but being a California resident, all good until you get popped and your Dr Lic and vehicle registrations don't match. Then depending on who stopped your and why your world becomes rather interesting.

                  You're playing with ideas about circumventing DR license, residency and ID laws (otherwise you wouldn't be asking here) and that is playing with fire. A lot of people will tell you how to do something and might even relate what they did (or the novel claims of how such a such friend did it) and that it's worked - so far. When it comes time for you to explain things or find yourself in legal jeopardy make sure to ask all those telling you how to get around the laws to donate to your legal defense fund.

                  You need to be talking to an attorney not getting validation to even consider doing things like you're asking about.

                    Federal laws/regulations prohibits a person from having more than one REAL ID compliant DL/ID. [6 CFR 37.29(a)]



                    Code of Federal Regulations Title 6 Chapter 1 Part 37 Subpart B Section 37.29
                    Prohibition against holding more than one REAL ID card or more than one driver's license.
                    (a) An individual may hold only one REAL ID card. An individual cannot hold a REAL ID driver's license and a REAL ID identification card simultaneously. Nothing shall preclude an individual from holding a REAL ID card and a non-REAL ID card unless prohibited by his or her State.
                    (b) Prior to issuing a REAL ID driver's license,
                    (1) A State must check with all other States to determine if the applicant currently holds a driver's license or REAL ID identification card in another State.
                    (2) If the State receives confirmation that the individual holds a driver's license in another State, or possesses a REAL ID identification card in another State, the receiving State must take measures to confirm that the person has terminated or is terminating the driver's license or REAL ID identification card issued by the prior State pursuant to State law, regulation or procedure.
                    (c) Prior to issuing a REAL ID identification card,
                    (1) A State must check with all other States to determine if the applicant currently holds a REAL ID driver's license or identification card in another State.
