    Estate gun questions

    An in-law passed away and had two guns. The children live out of state and are not sure of their options.

    If they want to keep one or both, what do they need to do if they are residents of WA? They are currently in CA dealing with the estate. Can they just take them home?

    If they want to sell one (to me) can the executor meet me at an FFL to do the transfer? They are both CA legal guns. Is there any way for them to sell both to me at once or does the 1 in 30 apply even in this situation?

    Not an attorney. It's easy if the firearms are bequethed in the will. They can take them with them. If not specifically bequethed, the executor can transfer them through a FFL in the Kids home state (WA). The executor can transfer them to you by PPT at a CA FFL. PPT is exempt from the one in 30 rule.

        Thanks very much. Now, what if the executor lives in another state, and the kids who want them live in WA. Would the executor have to travel to WA?

        Currently all kids, executor, and guns are in CA. But the kids live in WA, the executor lives in some other state.

          Can't do a PPT except in person. I dont know how the executor not being a CA resident effects their ability to do the PPT. That's a question for an attorney.

          If the executor takes them out of state and ships them, it becomes a regular dealer transfer and has to go through a FFL in the receivers home state. I don't know what that means for WA residents. WA laws apply. I dont think it has to be in person.

          For a CA recipient the transfers would no longer be exempt from the roster or 1 in 30 rule. Also transfer fees will be higher.

            Thank you for the info. The easiest thing will probably be for them to sell to me and then later if they want them I can transfer to them when things settle down.

                      Legally, guns crossing state lines need to go thru an FFL.

                      They can’t PPT it to you since they are not CA residents

                      It’ll need to be handled as an out of state transfer, call your FFL and check how they want to handle the “receiving” end of it.

                            Only a resident can ppt. If not bequeathed then if off roster cannot transfer.

                              Is it legal for me to hold them for a few months until they can come back and get them? Perhaps in a locked safe that I do not have the key to?
