    Another Turner's Rant(Sales Tax)

    I went to Turners in West Covina to purchase a handgun on 6/25/09.
    I paid in full. (Gun price, sales tax @9.25%, DROS, etc.) My receipt says paid in full, no balance owed. Pick up date is 7/05/09. I wait my 10 days to pick up gun.

    Sales tax goes up to 9.75% on 7/01/09.

    I go to Turners on 7/05/09 to pick up gun. Salesperson does all the paperwork to release my gun. I have to go to the cashier to finish the rest of paperwork.
    She tells me that I owe $2.63. I try to explain and to look at my receipt that I paid in full.

    Cashier states that sales tax went up, that Turners consider this an open sale because I hadn't picked up the gun and that the sale is not complete until it is taken out of inventory.

    Is this a stupid or what? Will most gun stores do the same? Is this a Turners only policy?

    If I paid in full, then it's paid in full!!

    same thing happend to my brother last week. he made his puchase at the norwalk store.

          My Quickbooks Point of Sale did the same thing. We put guns on sales orders until you pick up. You can pay it off in full, but the sales receipt is not run until you pick up. If the sales tax rate changes, the sale is not complete until a sales receipt is printed.

          Now when we had the April sales tax change, anyone who paid their gun in full, I just reduced their purchase price until it was even. Anyone who just put down some money, they ended up having to pay the higher tax.

          As a smaller corporation, I have the descretion to take care of that few bucks for you. As a larger company with lower level employees, Turner's probably doesn't.

          Honestly if it were me the $2 wouldn't be such a big deal. It really isn't that shady on their part, just part of the logistics of the ten day wait and local jurisdictions raising the sales tax. If they had the flexibility, they would probably handle it.
          www.tenpercentfirearms.com was open from 2005 until 2018. I now own Westside Arms.

                Ten percent apperas to be correct. I think many/all Turners locations had posted signs before warning that during tax increases that guns not paid in full and in layaway would be subject to the higher tax. I hate being taken advantage of in principle but in the case and for $2 and change I'd of understood.

                  Hey Deal, I missed your post, otherwise I wouldn't have brought it up.

                  $2 is isn't a big deal. It's just the principle. Turners knows how their sales system works. If they had said something that due to increase in sales tax, your purchase isn't final until you pick up and more money would be due. Otherwise, what does paid in full mean?

                  I thought I was being smart by buying before the sales tax increase.

                  I know now that it doesn't include guns.

                  They had a sign in front of the register stating the sales tax would increase, but didn't say that it would apply to purchases made before also.

                  Just had to rant. Rant over..

                    It's not Turner's fault. Board of Equalization's FAQs address this issue.
                    Number 10 specifically.

                        A sale is deemed to occur when your customer takes title to, or possession of, an item. Consequently, the applicable tax rate is the rate in effect when the merchandise is delivered to the customer unless your contract specifically passes title to your customer at a different time. Thus, the current tax rate is the applicable tax rate if your sales contract specifically identifies and passes title of the items to your customer before the tax rate increase goes into effect.

                        If you do not pass title prior to delivery of the items, and you deliver the items after the effective date of the tax rate increase, the higher tax rate applies.

                          You should've purchased it on 6/1/09.

                          You should of purchased it online and ship it to a local FFL. I will probably never buy a new firearm from a local gunstore because of their often high markups, and then now you get to add near 10% tax! Even factoring FFL costs I still come out ahead. Of course you should report that on your tax forms as I do for all out of state purchases.

                            no, not a turners policy....its kind of a CA Tax Law Policy. The actual tax is collected from the purchaser at the time of collection of product purchased. It would have been no different if you placed an order at Cole's Carpet on 6-25-09 and picked up after the 4th. Complaints for this issue should be directed to www.ca.gov/
