Paypal stole $16K from me. Has anyone gone to arbitration ?

    Paypal stole $16K from me. Has anyone gone to arbitration ?

    Hello,

    Paypal limited my account and stole $16k that was in it for "policy violations" for selling firearm related parts. They told me they would hold the $ for 180 days. It is now 182 days so I started contacting them.

    They clearly said they seized my money because I sold a HATSAN air stripper for an air gun. Air guns are NOT prohibited items per paypal, they even provide buyer and seller protection for airguns. Because someone at paypal labelled this a "firearm part" is where the problem came from. The sale was clearly listed as for an AIRgun, with 1/2x20 threads.

    What I want to know is has anyone gone to arbitration against Paypal, and what was the result.

    Please do NOT post if you have not yourself gone to arbitration or were not a first hand witness to someone who did and know the outcome.

    Please do not post "I don't know, but my opinion is...." unless you are a currently employed attorney and therefore qualified to answer this question.

    I sent an email request to my regular business atty this morning, and while I am awaiting a response I thought I would ask if anyone has direct or near direct experience of an arbitration with Paypal and what was the result.

    I would very much like to hear from anyone who has a real answer to this question.

    I want to know what my chances are of getting my money back before spending the $$ on arbitration.

    Your chances of "winning" at arbitration hinge on what the PayPal rules are and whether you violated the rules, and obviously a fair and just arbiter.

    Does the PayPal agreement require arbitration and prevent you from suing?

    I will assume for the sake argument that PayPal's rule that they simply get to keep all the money of anyone that violate their terms is legal.

      Because there is a arbitration clause, I must arbitrate and not able to sue
      The question will become are their rules reasonable valid legal and enforceable.
      I don't see how having sold an airgun muzzlebreak on ebay "damaged" them for $16,000. That might be a weakspot in their case.

      I'm hoping to hear back from my business atty tomorrow for his opinion. Depending on what he says either I will drop it or file for arbitration.

        You waited 180 days to get legal advice on a $16,000 loss? I am not an attorney and I have not stayed at a Holiday Inn Express so I guess I am not able to help you. Good luck.

            PayPal is the devil, I knew this in 9th grade, we yank that even if it has $1.51, PayPal charges $1.50 for a check, I would want my penny...

            I will give you advice but its harsh, people have been dealing with this since two decades ago and still lose, so the advice I got for you is that, it's a battle a lot of people tried to win but end up losing . They will make you go crazy..

            I truly feel sorry for your loss , but you should take account for all your investments/financial and read into the policy, especially being pro 2A, it could of been an airsoft spring , and get your money loss, we in CA, PayPal and eBay ain't playing, they playing for keeps literally.

            Also don't call people idiots because I can ask, tell me your an idiot without telling me your an idiot...

              You're selling broken muzzles? No wonder they shut you down.

              Also, using PayPal was your first mistake and your second was leaving such a high balance in your "account" with them.

                You misread him, he sold an air gun part and PayPal says he is damaging them, I believe an air gun part isn't even consider a firearm so he is going to fight that, just be ready to go crazy with phone calls and time , headaches . If you can make $16k faster, I would just give up.

                    He wants his 16k, but cannot accept the fact it's gone, and he called a bunch of people idiots in the other thread but many people are telling him he is an idiot for keeping such a high amount into that is not a *bank*...

                        Why are you keeping 16k in PayPal's account?! Why not move it to your bank?

                          I never bought an airgun, and don't know the law for it's accessories. Someone stated above this forum that it doesn't count as a firearm part due to it being an accessory. Upon research, I did find this. Sorry for the misunderstanding.


                          Your recipient will need to have their Federal Firearms License to receive the air gun. Otherwise, you need to send the gun to a pawn shop or gun store in the buyer's state so they can pick it up. They also have to sign for the delivery

                            I've never arbitrated against Paypal, never followed the proceedings of someone who arbitrated against Paypal, I don't know the results of any arbitration against paypal. But I'm replying anyway - what are you going to do, sue me? Or maybe filing an arbitration request against me with the moderators is more your roll?

                            I'm a currently employed attorney, but not your attorney. I also don't practice business law. Does this make me qualified to respond? Again, what are you going to do, sue me or anyone else responding?

                              Amazon sells air rifles shipped strait to your house. Wasn't that long ago a guy from Sacramento was on the news complaining about that when his kid ordered one without his permission.
