    HELP with transfer from a dead best friend

    Background: Friend i've known since 42 years died (time edited). He was a poor handicapped guy living in a state subsidized apt complex. No will, just a bunch of people that knew his wishes as far as his weapons.

    Cops called, they come in, found dead, take all his weapons, took keys off keychain so i will have to break into things, took computer, left his 67 mustang unlocked, stereo stolen (they took the ignition key).

    So... he had made me the emergency contact a year ago. I get apt keys tmrw dealing with what little he has and the family. I know he wants me to have his Walther that I admired for 30 years, 38 special should go to another friend. His family knows this.

    DOJ wants to release the guns to his oldest sister in Oregon. She says she plans to immediately transfer all of them to me. Guns never leave the state.

    So is this doable? I am trying to line up a FFL in preparation. Keep in mind Sheriff is releasing the guns to an Oregon resident and her intention is to give them to me.

    Does have other sisters that are Ca residents, but these are not the eldest. Maybe I can go this route, I am not sure why

    Update: Turners said, have Oregon resident sister take possession. Go to Oregon and ffl hip back to Ca ffl, i go through the BG check and take possession. Yes this is what Turners advised and they did give it some thought and want to help me. this sounds risky.

      FIRST rule of getting firearms legal advice is "DON'T ASK TURNER'S COUNTER MONKEY".

      If you post an approximate location. CG members can guide you to a "REPUTABLE - KNOWLEDGABLE", FFL in your area.

      You will likely require the services of a probate attorney who also knows firearms laws.

        Sry guys, little sleep. Sacramento area prob downtown sac. Sac county property room.

        Talked to a few FFLS. Turners is the only one that verbalized a method.

        I also have time constraints to dismantle his apt in 8 days.

          Shoman100, call the gun store or river city gun store. Last time I was in Sacramento I stumbled across these (2) on my downtime from training. They seemed to know quite a bit. Just more options for you.

            Don't let them leave the state. If off roster won't be coming back. He's your brother and local. Why are they going to sister?

                "Friend/bro", not "brother". They'll be gone forever if roster-restricted. Either you or the gun (how old is said Walther?) would have to be exempt. I think what Turners said is otherwise legal. Sister takes possession/ownership due to probate/will etc. She immediately sells cause she doesn't want them. All through FFLs, that's not a straw purchase since she's not buying them. But, it will be much easier, if all the transfers remain inside CA, as it would be a PPT from another CA resident instead of an out-of-state transfer from OR.

                  All old off roster late 80's, 90's maybe one 2000 sig pro. Couple of Pistols and a Ranch Rifle.

                    update: Will talk to another Ca based sister for a Ca resident to Ca resident PTP transfer. I have to convince her, she a J Witness. I think I can.

                      That may be a viable option. If elder Sis, signs a "Power of Attorney" for firearms over to Cali Sis. She becomes older Sis's legal agent for disposition of firearms.

                      I still suggest running options with a knowledgeable attorney.

                          You should have the sister in Oregon call the DOJ.
                          It may be possible to send a nortirized letter to release the guns directly to you..
                          Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.

                              Sorry for your loss.

                              Since it appears that the OP’s friend was a California resident and had no will, his property will go to whomever is entitled to it under California intestate succession laws. And if that’s the eldest sister, that’s who gets the guns.

                              Since that sister is a resident of Oregon, federal law requires that the guns be transferred to the OP through a California FFL. Any handguns not on the roster (or exempt) would not be transferable to the OP.
