    Private party sale

    Someone I know has two rifles (20 gauge shotty and ruger M77 .257 Roberts) that he needs to get rid of ASAP... Reason being is tomorrow he's going to court to accept a plea deal which will make him a felon.

    I prefer to transfer them via ffl but he's worried about getting charged for felon in possession if he brings the firearms to complete transaction. How do we proceed ?

    Yikes.

    Can you transfer at an FFL before going to court?

    Some of the home FFLs may be able to help quickly.

    UG imports is well regarded here.

    Do not take possession without a legal transfer.

    OP is in San Jose if others know better suggestions.

        Have him contact his friend's lawyer to have the lawyer transfer the guns on his behalf.


        Or get to an FFL before he accepts the plea deal, as at that point he's not a convicted felon and at that point they'll be in your name, not his.

        BTW, my Dad was a convicted felon. He was a bookie.... he took bets on horse racing. Apparently the government frowns upon that, mainly because they don't get a cut. So it's a felony, and he had to sell all his guns.

            OP, I hate to say it, but let the guns go. I wouldn't get involved in anything like that. If you can find a legit way, awesome. But sounds like more trouble than its worth.

                Sometimes life happens and you pick up a charge. It's gonna be tough to find any place near San Jose to do the transfer, especially if he's set to be sentenced early in the morning. His lawyer will be better equipped to find a resolution than most of us here

                  I would suggest reading the form that is required to be filled out with every conviction that would result in a firearm prohibition, such as a felony.

                    As I read it. Specifically take note of sections [D] and [E].

                    Friend could designate YOURSELF as POA. At which time you have either 5 or 14 days, to sell his guns to yourself.

                    And he is NO LONGER in possession.

                      As a prohibited person, they can grant another person power of attorney for the purpose of legally disposing of firearms they own.

                      This is done by submitting a completed General Notice of Firearm Prohibition and Power of Attorney fore Firearms Reliquishment, Sale, or Transfer for Storage (BOF 110) to CA DOJ BOF.

                      Within 30 days of submitting the form, the person with power of attorney must dispose of the firearms in a legal manner by either selling them through a FFL dealer or having them stored with a FFL dealer or surrendering them to law enforcement for destruction.

                      The person with power of attorney can not legally keep the firearms or possess the firearms after 30 days.

                        I doubt there would be a problem selling them BEFORE he becomes a felon, unless there are other problems involved--restraining order, etc.
                        Not a lawyer. Perhaps call a transfer dealer??

                          Tell him to talk to his attorney. That's what attorneys are for.

                          Asking for that kind of legal advice on a public forum is both stupid and ridiculous.

                            The entire legal process leading up to a plea agreement doesn't happen overnight. There was lots of time to deal with this, asking for info at 9pm the night before rarely gets good results.
