    Ex-SD County Sheriff's Captain Sentenced Two Years in Gun Trafficking Case

    SD county sheriff captain, Honey Badger firearms, prominent SD jeweler and another guy.... Wonder if any of them were CGers.

    Considering the totality of the corruption (and probably just the tip of the iceberg) here, two years prison was way too little. The federal dealer requirement is an unconstitutional prior restraint on a fundamental right. But it is at present the law and the easiest charge to prove.
    Considering that the felonious conduct occurred on the job, are they going to strip him of his retirement?
    The purchasers of the guns should worry; they might be prosecuted under a conspiracy charge.

      He forfeited 5,835 rounds of ammo as part of his plea deal. I've got 3x that in 22LR alone.

        While I am in complete agreement that he needs to do some serious time, there is no provision in law that would strip his retirement.

        Think about what he gave up and the total cost to him for a few extra thousand. So stupid and disgusting.

          Local news actually stated his pension would be under review based on his felony conviction. At the very least he was stripped of service years from the date he committed the first offense so all of his retirement etc is being recalculated. They did mention he would be paying back the pension collected this past year at least.

            Please see Government Code section 7522.72(b)(1).

            There has been a lot of discussion as to whether this section could be used to strip persons of benefits accrued prior to it's enactment. The County of Los Angeles elected not to pursue efforts to strip former Sheriff Lee Baca of his pension based on this reasoning.

            But in the case of the former San Diego Captain, there would be a large portion of his pension (that accrued after 1983) that could be forfeited even under this reasoning.

              Just think of all the heroes who would still have good paying jobs, would not be in jail or would not have felony convictions if they and their unions were not complicit in creating a carve-out for themselves regarding off-roster handguns.

              This hero's lucky; he'll be collecting a pension equivalent to 81% of his salary even while he's sitting in prison.

                  Like most of the off roster guns in the marketplace aren't coming from the same place... They just space it out more

                      That is why the handgun roster is an extremely clever sneaky invention. It induces the greedy human behavior to create the "off-roster" marketplace.

                              I really do not care very much about his gun scheme. Not worth jail time to me. Just fire his butt and yank his retirement. Saves the expense to the Feds of jail time and saves the County retirement system money too.

                              I am for ANY exception to get off rosters into the State.

                              What really bothers me is the scam with the weed farmers and warnings of raids. The quid pro quo That is flat out corruption activity. And for that 2 years is not nearly enough. He should have been thrown under the jail for corruption alone.
