    If indeed biden, by EO, started planning confiscation, what agencies would he most likely task the plan to ?

    ATF already does that don't they? But they're not going to mass confiscate. They'll do what they've been doing, by accident from traffic stops and complaints from loose lipped family, friends and acquaintances.

Check out my posts and see if there is anything in them that would warrant the tin (foil hat) comment. captn-tin is the name my best fishing partner gave me when I bought my 1st aluminum boat.                 How would the President accomplish gun confiscation by Executive Order?

                Make sure that you understand what an Executive Order is, and is not, before responding.

                He may be able to achieve confiscation of weapons marginally meeting NFA criteria by directing NFA enforcement efforts via and EO, but there's no avenue of reaching mainstream weapons through EO.

                  If there was, Obola would've found it. He assigned a task force to try to get around the law specifically to do this. They came up with a bunch of smaller tactics to be pains in the ***, but confiscating or banning, they came up empty.

                    RD427 For the sake of argument lets say gun confiscation was passed in congress and biden signed the legislation. What agency would be tasked with enforcement? I do know the limits of EO, but don't, for a second, think the proglibdems wouldn't try.

                        DHS PACT:

                        Established within DHS by the Trump Administration, it can be redirected by administrative means or EO. Since ICE and Border Protection will no longer be needed, those assets could be re-directed under PACT to execute a confiscation if Congress legislates confiscation.

                        The DHS Protecting American Communities Task Force – often abbreviated PACT and commonly referred to as the Protecting American Communities Task Force – is a departmental task force of the Department of Homeland Security. PACT is mandated to officially coordinate riot control and security police operations to protect monuments, memorials, and federal property, monitor civil unrest, protect civilians from rioting or vandalism, or respond to the destruction of federal property by protesters. PACT was formed on July 1, 2020 in the wake of the George Floyd protests under direction of Acting Secretary of Homeland Security Chad Wolf. The task force is also mandated to coordinate its law enforcement efforts with the United States Department of Justice and United States Department of Defense. PACT has attracted significant controversy and criticism from various media outlets for its operations and alleged goals.

                        Role and controversy

                          I'm sure that there will be legislative efforts to implement gun control during President Biden's term. Pretty much all of the Presidential initiatives that I've read about will require legislation and could not be accomplished via Executive Order. All he needs is a majority in both Houses of Congress and his signature to implement legislation. Democrats have a majority in the House. The Senate is tied with the Vice-President having the "Tie-Splitting" vote. There are also 3 (or six depending on how you count) republican senators that have recently supported democratic party initiatives.

                          Once passed, any new gun control legislation would be subject to constitutional challenge. That one is really a wild card. The Supreme Court has not been highly receptive to such cases (Heller and McDonald were a long time ago). We need to see how Justice Barrett's presence on the Court may change things.

                          It's really not possible to say with any certainty what the enforcement mechanisms would be since the legislation isn't even on the table yet.

                          In very general terms, a Presidential Executive Order, is an order given by the President to government employees that serve under his command. It's just like an "General Order" that the head of Ford Motor Company may issue to Ford's employees. The head of Ford can direct his employees to report to work at a particular time, and to wear specific safety equipment while working. But he can't use his "General Order" authority to direct Michigan state residents to buy only Ford automobiles.

                              Isn't Roberts still the gatekeeper? He isn't going to take any 2A cases any more.

                              Biden has been legislating from the White House. He's telling ICE and CBP to defy standing law that was passed by both houses and signed into law. If that's legal, it shouldn't be.
