Commander Tarn, is English not your native language? Whose guns were they? Your friends? His older brother? The father?Alright so this is a question that has been bothering a friend of mine for some time now, what he would like to know. Is 2 years ago his older brother whom he lived with ended up falling to the drug side and so the house was raided by police due to his father before this he was a good guy, great career no criminal record but his girlfriend dumped him and he ended up in the dog house, now when the police raided they seized some rifles and some handguns these were legally in his possession before since he was a gun collector/enthusiast. These were beautiful WW2 pieces and well his younger brother was wondering if there was any possibility of getting em back? It maybe to late now but the curiosity wasn’t something he could ignore anymore so what do you guys think?

Well to answer your first question, English is my native language, its just my ability to ask questions is sorely lacking lol, that said to answer your second question the guns belonged to my friends older brother, but his younger brother was hoping he could retrieve them if they even still existed. Which as you just said they are probably gone by now

1. Your friend's older brother became a prohibited person due to illicit activity involving controlled substances and was raided by police.
2. The firearms were confiscated as a result of the raid.
3. Two years later, your friend wants to know if there is a way for him to obtain those firearms.
The answer to that is... No.
Firearms that are not being held as evidence and are unclaimed after 180 days of being confiscated are subject to disposal or destruction by the LE agency that confiscated the firearms. [PC 34000(a)]
Once a person becomes a prohibited person, they have 14 days to dispose of any firearms or ammunition they own.
This is done by granting a third party power of attorney to acquire the firearms from the LE agency and transfer them off.
^The person that is granted power of attorney can not keep any of the firearms and any firearms that are not transferred within 14 days are surrendered to law enforcement for destruction.Last edited by Quiet; 12-18-2020, 11:20 PM.sigpic

This almost happened to my friend's older brother's father's older brother so he just kept them in a hidden in a dirty used meat smoker tied to the back of a RV that he would park in front of other people's houses.

I'm just joking and I'm sorry that your friends guns are more than likely destroyed by now.Comment

Disposal as in, ended up in some LEO's collection maybe. Seen it happen with distant cousins in LE in Indiana. Small town cops bragging about getting guns and other valuables that were seized. I have known people that have managed to get their property back from LEO after significant amounts of time, so I think it may depend on the agency that got ahold of the guns. If your friends father, who was apparently the original owner, can provide some kind of proof the guns belonged to him, he might be able to contact the CLEO about getting them back.
