    Arrest for High Capacity Magazines

    Thought this was dealt with after the Tulare case, but someone in Folsom just got charged with possession of high capacity magazines while being picked up for warrant violations. And just guessing from the other charges, a loaded and concealed AR pistol made from an 80% build.



    The man in question is an engineer, looks like he used to build wooden replicas of firearms as puzzles. Guess he’s moved on to real ones?

    6:15 p.m.: Cary Chleborad, 50, of Folsom was arrested at the 1100 block of Meredith Way for outstanding warrant, large capacity magazines, possession of assault weapon, assault weapon and rifles, carrying a loaded firearm not registered and carrying a concealed weapon. Chleborad was booked at the Sacramento County Jail.

      Several felonies for this brig bunny. OP's title not accurate. No such thing as high capacity magazineas. He was not charged with that . Only large caps laws in Ca.

        There's really not enough detail in the press release to determine what happened. It's worth noting that the arrest charges included "large capacity magazines" and not "possession of large capacity magazines." I'm not sure if there is significance to the omission of the words "possession of" in the press release.

        The state's charge table reduces the great many words of a criminal offense to just a few words that describe the offense, often with the lot of inaccuracy resulting.

        The state's Large Capacity Magazine statute (Penal Code section 32310) has four separate clauses to it. The clause prohibiting the simple possession of a large-capacity magazine is the subject of a current federal court order prohibiting enforcement.

        The clauses prohibiting the manufacture of a Large Capacity Magazine (to include the assembly of parts into a magazine), the importation of Large Capacity Magazines, and the purchase of Large Capacity Magazines remain in effect and enforceable.

          This is just charge stacking SOP charge everything that will scare the victim err perpetrator into taking a plea. Let's see what his lawyer does. My guess is they it won't matter as he will take a plea just as 90%+ do.

                ^^ Not in CA we don't. To broad a definition my 1911 holds 7 and muger ruger 10, my 1911 officers holds 5, my bar 3. Your in the east where your deer are so small you have to add both sides of antlers to get a decent count. Here in the west we are more accurate a 4 point here only has 4 in the east you double everything so 4 point becomes 8 and you have to take your shoes off to count to 12 looking down.(LOL)

                    Concerning the topic, dude got charged with stuff because he was getting charged with everything. Take care of your warrants...

                          ATF Form 4473: If a frame or receiver can only be made into a long gun (rifle or shotgun), it is still a frame or receiver, not a handgun or long gun.

                            Guy had a warrant got arrested. If a traffic stop Cops have to inventory car or maybe he let them search. . From the quick write up looks like he broke a bunch of laws with a warrant for his arrest.
                            Not like he was at a Shooting range with legal firearms using a Large cap magazine legally. And he was arrested for the Hi cap magazine.
                            I'm betting this guy has a record.

                              No idea whether this guy already has any felony convictions.

                              That is just an arrest list, not DA charges for trial. Usually the cops will list everything they see & find and it will be up to DA what to use when charged. The longer the list, the easier it will be to get him to plead out to lesser charges.
