Question on registering off roster gun in california

    Question on registering off roster gun in california

    My cousin is in the army and told me I could have his CZ P10F. He is in colorado and says guns don't have to be registered there.

    He has the gun in california and will allow me to meet up with him to grab it.

    I looked at the DOJ form for registering a firearm. Is that all I need to do?

    Are there any issues with getting his P10F and registering it under my name without any ffl or anything since the gun was never registered to begin with?

    Just trying to figure out the best and safest way to do this.

    He is not a california resident but used to be. He is a resident of Colorado for the time being.

          Of course I am clueless. I am not that involved with guns.

          I had one when I was in GA. Shot it a few times.

          Sorry I am not a gun expert. Which is why I am asking.

          So at least I am smart enough to ask to avoid getting in trouble and doing something stupid without knowing right?

          I appreciate the other replies. It just seemed too straightforward when you look at the firearm registration form.

          If he gives it to an immediate family member living in california and then we do a face to face transfer at an ffl would that then be legal?

          Is there a legal way to do it that does not cause any parties any issues?

                I have owned a CZ shadow when I lived in GA, it was my first gun and my ex ran off with it and lives in Canada now.

                I shot it occasionally at ranges and kept it for home defense.

                Just trying to find the safest way to get this gun in my hands since my cousin isn't charging me more than cost.

                Obviously other people here are selling off roster guns for 2x-3x the price and they seem able to.

                Why can't he transfer the gun to an immediate family here in california and then I buy it from that family member through an ffl?

                  You are right to ask, because this is un-obvious.

                  First, the net is you cannot have that gun from your cousin.

                  Federal law requires that the transfer - here, CO resident to CA resident, or any transfer between folks who do not live in the same state - occur through a FFL.
                  -- You cannot legally go to CO and get it, he cannot come to CA and just hand it to you.
                  -- You cannot somehow get it and file paperwork.

                  Someone from out of state cannot come to an FFL and transfer an off-roster pistol to you unless you are exempt from the Roster (usually LEO) OR the transfer itself would be exempt.

                  Immediate family would be exempt. CA law says 'cousin' is not immediate family, just parents and grandparents.

                    Any gun crossing state lines must use an FFL. He is not a resident here so ppt is off the table. CA only considers Father, mother, daughter, son your immediate family

                      Because then that immediate family member would be acquiring an off roster handgun for YOU. What your describing is illegal. If the cousin was gifting it to their immediate family member for THEM to keep, and at a later date THEY decided to sell it. No big deal. But what your saying is not that situation.                         He cannot give gun to family member here who will then do a dros/sale with you. That is a straw purchase. Use search there are a lot of posts on this subject. No legal way for you to get off roster handgun from non immediate family from out of state or even shipped within state.

                            If people could bring guns in from out of state nobody would pay 2x-3x. There is no legal way for you to gat that gun here in California. Sorry. Californian Gun laws suck

                              I appreciate the responses and don't need further clarification.

                              I guess I'll just enjoy the xd9 I'm picking up in 9 days. That should suffice for now till I get an SP01.
