    Trouble :(

    Helped a friend of mine move his gun safe today. He took it all out and we moved everything. As I recall he bought a bunch of lowers years ago and was hoping he still had them; and noticed he didn't. Thought maybe they were in the boat he lost or something.

    Anyway I finally broke down and asked thinking I might try to buy one - I know he's broke at the moment. He told me they were stolen years ago. Bummer I thought. Then he says he didn't know they were taken until recently even though he thinks it was years ago they were taken. He thought he had kind of buried them in his house and didn't realize they were gone until he started moving a few weeks ago. Crapper - how much trouble is he in?

    I assume he never reported it, he should file a report about them missing that way there's a trail if they are found ?

        How did he not knoww they were stolen though? Not being dismissive but curious.

          Well I told him he was in trouble; it was my assumption that since they are registered to him and not in his possession he's in trouble? He said he left his home to a sitter some years ago and they were "burglarized" and he always assumed the sitter did it. He said the lowers were built into a cabinet and he never took it apart to find they were gone until a few weeks ago. He thinks it was then - they were taken. There was a police report of his burglary but he didn't report any firearms stolen.

              Not really. No different then if someone stole your car. It sounds like he has no idea what happened to them. Your can’t report something stolen unless you know it is stolen.

                  The police would ask at that point, were any firearms stolen. That was his chance to do an inventory. You probably can't go back and say you didn't know now, any judge would laugh at you.

                      He discovered today they are missing.
                      "Thinks" it must of been years ago but actually does not know when stolen.

                      25250.


                      (a) Commencing July 1, 2017, every person shall report the loss or theft of a firearm he or she owns or possesses to a local law enforcement agency in the jurisdiction in which the theft or loss occurred within five days of the time he or she knew or reasonably should have known that the firearm had been stolen or lost.

                      (b) Every person who has reported a firearm lost or stolen under subdivision (a) shall notify the local law enforcement agency in the jurisdiction in which the theft or loss occurred within five days if the firearm is subsequently recovered by the person.

                      (c) Notwithstanding subdivision (a), a person shall not be required to report the loss or theft of a firearm that is an antique firearm within the meaning of subdivision (c) of Section 16170.

                      (Added November 8, 2016, by initiative Proposition 63, Sec. 4.1.)
                      If stolen before July 1 2017 than gets a pass.


                      Section 25250 shall not apply to the following:

                      (a) Any law enforcement agency or peace officer acting within the course and scope of his or her employment or official duties if he or she reports the loss or theft to his or her employing agency.

                      (b) Any United States marshal or member of the Armed Forces of the United States or the National Guard, while engaged in his or her official duties.

                      (c) Any person who is licensed, pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, and who reports the theft or loss in accordance with Section 923(g)(6) of Title 18 of the United States Code, or the successor provision thereto, and applicable regulations issued thereto.

                      (d) Any person whose firearm was lost or stolen prior to July 1, 2017.

                      Not sure if they can stack each lower as first, second, third violation if all stolen at same time?

                      25265.


                      (a) Every person who violates Section 25250 is, for a first violation, guilty of an infraction, punishable by a fine not to exceed one hundred dollars ($100).

                      (b) Every person who violates Section 25250 is, for a second violation, guilty of an infraction, punishable by a fine not to exceed one thousand dollars ($1,000).

                      (c) Every person who violates Section 25250 is, for a third or subsequent violation, guilty of a misdemeanor, punishable by imprisonment in a county jail not exceeding six months, or by a fine not to exceed one thousand dollars ($1,000), or by both that fine and imprisonment.

                            Exactly. When I moved out of the apartment I had lived in for 25 years, I found a couple guns I had reported stolen because I thought they were in my safe. They were at the bottom of a pile of crap that started forming in year 1.
