    Buying from gunbroker. Is there a sales tax?

    Hi! I gave up on Turner's wait list. If I buy from somebody out of state at gunbroker.com, will I be accessed a CA sales tax?

    If you can't prove you paid sales tax the ffl must collect it.

        You have to pay CA sales tax somewhere. GB may collect it, the seller may collect it or the transferring FFL will collect it. You need proof that you paid it or you will pay it again.

              You must report your purchase of a vehicle subject to use tax. In general, use tax applies to purchases of vehicles for use in this state when an amount for sales tax is not paid to a California dealer. This includes purchases from out-of-state sellers, private parties, or California dealers when delivery of the vehicle is taken out of state. Unless an exemption or exclusion applies, you must pay use tax on your vehicle purchase. Generally, you will pay the use tax when you register your vehicle with the Department of Motor Vehicles (DMV).

              From a quick google search:

              "However, if you purchased a vehicle without completing registration and paying the use tax to the DMV, you must pay the use tax directly to the CDTFA. You can report your purchase of a vehicle and pay the use tax by using the CDTFA's online services and selecting the option to File a Return or Claim an Exemption for a Vehicle, Vessel, Aircraft, or Mobile Home under the Limited Access Functions.

              Your tax payment is due on or before the last day of the month following the month of purchase.

              Penalty and interest charges will begin to accrue once the due date has passed."

                Yes.
                You pay it when you register the vehicle in CA.
                It might be called use tax instead of sales tax but the difference is only in who collects it.
                The rates are the same for sales tax (collected by a seller and forwarded to the state) and use tax (collected by the state directly from the consimer).

                    Every gb listing says whether they collect sales tax or not. Look for it.

                      almost every FFL that transfers the gun will require you pay sales tax as they are required to. If they find the invoice in the box, they will base the sales tax owed by that amount. If there is no invoice, they will ask you what the cost was. If you say an underreported amount, most will get suspicious and may lookup average sales price to determine the tax.

                        Yes you'll pay CA tax when you transfer it. Also make sure you can bring it into CA as a used car. If you transfer it in the state you bought it in and paid their tax CA will charge you the difference between what you paid and what is due in CA.

                          In the past, my FFL collected it. But if the seller collected it from you, I don't think that the FFL would collect it again.

                              I've never had a seller collect tax. But sometimes if you're lucky, the seller will forget to include the invoice, or it'll get lost in transit or something. And then a receiving FFL can't charge tax.
