Send Firearm to Family in CA?

When I was still in CA I inherited all of my deceased fathers firearms. When I moved to GA I took them with me and for the most part they have not been shot in 10 years. Well my sister and I got to talking about guns and she asked me if I still had the HG that our dad taught he how to shoot with. I told her that I do still have it and she asked if she could have it for sentimental reasons. My questions are: 1. does the handgun need to be on the roster for her to own it? 2. Do I need to do a transfer from one family member to another via an FFL? 3. Are there any special rules around family member transfer or ownership that I need to be aware of.

Handgun in question is a Colt Woodsman and a Colt Series 70 .38 Super 1911.

    Thank you for your feedback.

^^^ All of that is correct

Unless those handguns are 50 years old or older, there is no way to get them to your sister directly. There is a good chance the Woodsman is 50+ yrs old. Run the serial numbers on the Colt website and see

Serial Number Lookup Please be advised that the information provided here is approximate, and should not be relied upon for legal, compliance, valuation, or other purposes which require definitive documentation. Enter the serial number, without spaces or dashes, to search the database. If multiple models appear for your serial number…

If they are not 50+ yrs old, and if your mother is alive, you could give them to her. Then maybe someday she would like to transfer them to your sister, and that would be a roster exempt transfer. (mother to daughter is allowed in CA, brother to sister is not).

A Series 70 can't be 50 years old, because they came out in... the 70's.

But neither will be on the roster.

and...therefore can't be transferred by you to your sister. Her mom or grandmother could transfer them to her as interfamily transfers are not limited by the roster. All interstate transfers must go through an FFL by federal law not CA law.

Over 4,500 Series 70 pistols were made in 1970, making all of those C&R eligible and roster exempt over the course of this year, specifically when depends on the month of manufacture which can be obtained from Colt customer service.

Run this serial number on the Colt website....
              70G01001

              Year of Manufacture 1970
Model GOVERNMENT MODEL MKIV SERIES 70
              2020-1970=50. Time flys...

They won't nitpick saying it might have been made in December? Sounds unKalifornia-like.

They will nitpick, which is why a phone call to Colt customer service is required to obtain the month of manufacture, if you want to get in the 50th year and not wait until the 51st year.

I can't believe both of you have forgotten that your dad gave those pistols to her when he was alive.

That would be a useless lie. The guns are in the possession of the brother, a resident of Georgia, so under federal law they would have to be transferred to the sister, a resident of California, through a California FFL.

Who has legal title to the guns is irrelevant. What matters is physical possession.
"It is long been a principle of ours that one is no more armed because he has possession of a firearm than he is a musician because he owns a piano. There is no point in having a gun if you are not capable of using it skillfully." -- Jeff Cooper
