    Shipping M-1

Hey guys, My friend has two M-1 Garands (one is for me ) that he inherited from his grandpa. A Winchester and Springfield just so you know, but these rifles are in Maine, and my question is do these rifles have to be shipped FFL to FFL? or can they be sent to our FFL on base directly from his dad? I would ask our FFL but i cant get ahold of the guy i want to talk too since hes semi retired. Any help would be appreciated, and i also did a search here but couldn't find anything relevant to my (our) problem. Thank you in advance.

Just make sure your local FFL is OK with this. Some FFL's have a personal policy of only receiving firearm shipments from other FFL's.

Hey wait a minute. You said "inherited". If his grandfather passed away then your friend can receive the firearms directly. No FFL is needed. But if his grandfather is still alive and is just "giving" him the Garands, then they will have to be sent to your local FFL.

i'm assuming you don't have a C&R licence, correct? 'cause if you do, that changes everything...

Not exactly, I gave him a great deal on a slighlty used marlin 336 and i let him make payments so he is returning the favor.

We have a Rod&Gun club on base that has an FFL, but it is not part of AAFES. It is open to AD,Res,Guard,Dependents and DOD employees or retired military if youre in the area.

So if they are inherited his dad could just Fed Ex them overnight correct? Any Fed or Cali paper work he has to fill out to bring/mail these?

If the guns were bequested to your friend by his grandfather's will, or if in the absence of a will (or if the will didn't mention the rifles) your friend inherited the rifles from his grandfather via intestate succession (like if the executor of the grandfathers estate felt the grandson should have them), then the rifles can be shipped directly to the grandson.

They can be shipped USPS, UPS, or FedEx. Since they are long guns there is no requirement that they be shipped UPS or FedEx "overnight" service. Regular ground service is fine.

And since they are long guns, there is no paperwork involved. Handguns would have to be registered with CalDOJ via the "Operation of Law" form and $19.

There is some sort of exemption for the CMP because they're a government agency. Don't ask me for a section of code...

When you get them shipped please pony up the extra coin for adequate insurance, in case something happens to them in route.

It should be able to be gifted on down the family tree if need be. Grandfather to father. Father to son. Then once the son has them in his possession, he's free to give one to you since it is a long arm over 50 years old. No FFLs or C&Rs needed.

Nope. Gifting doesn't work when you are dealing with two people who are residents of different states. Federal law requires transfers between two residents of different states (even family members) to go through an FFL. As mentioned above, there is an exception for transfers involving bequest or intestate succession. So if the firearm is coming from the estate of a somebody who has died, it can cross state lines without going through an FFL. California adds an additional restriction requiring the firearm to be coming from the estate of a grandparent, parent, or child.
