You cannot put a 10.5" upper on that lower because it is dros'd as a rifle. A 10.5" upper would constitute an SBR, which is illegal without the proper paperwork. Even if you fixed the magazine and replaced the stock with an arm brace (in pistol configuration), you still have a rifle lower - which is illegal. You need to have a lower that is registered as a pistol, in order to use a pistol length upper and other pistol features.
You can use a 14.5" upper if it has a flash hider or muzzle brake welded to it to create an overall length of 16 inches.
