    Home Defense Question(s)

    If not already talked about, (I'm sure it has been) can someone post or direct me to the thread which talks in detail about using your firearm in self-defense on your property (where/when it is legal to use deadly force in CA)? Must it be inside your house? Can it be outside on your lawn? etc.

    Also, when open carrying an unloaded weapon and if one was to encounter a situation where they felt their life was at stake (i.e. criminal had a gun pointed at them or was trying to do physical harm) is it lawful to use deadly force when not on ones own property?

    I'm sure in both cases all parties will be arrested for questioning (if all survive) but I guess "its better to be judged by 12 than carried by 6"

    Can anyone help me out here in case this ever happened (god forbid)

    Unless your life is in immediate danger and you can prove it, I think you are in trouble firing a gun in self-defense anywhere in our wonderful state - even if it's in your bedroom. And even if you are vindicated in your decision, prepare for years of legal proceedings and to lose the gun you used.

      That's why I use a shotgun for home defense. Effective and cheap if you have to replace it.

        while you have 911 on the phone... scream really LOUD:

        so if that scenario fits, you're more than halfway home.

          I recommend everyone read Massad Ayoob's materials on self defense court cases where clearly justifiable shootings were jumped on by anti-gun lawyers and judges. If you read back issus of American Handgunner and Combat Handguns you will be amazed with what our legal system does to innocent people who saved their lives from career felons only to be accused of murder. Since many of these cases are in gun friendly states, I have no doubt how our socialist legal system would deal with one of us in Kalifornia.

          My precautions include a factory spec DA only gun and factory ammo. Don't want to be portrayed as a blood thirsty killer with a hair trigger gun and "killer" handloads.
          In an emergency, always dial 1911.
