    Guns held by police in CA

    The guns are: Category 3 non compliant assault weapons In CA.

    How do I get my California non compliant rifles out of police hands?

    Does anyone know the steps.

    Lots of gaps in the information given, but...I'm willing to bet that you're SOL, if you're talking about illegally configured assault weapons that were seized for some reason by law enforcement, in California.

              That's a very plausible explanation.

              With the information we have so far, it's a pretty sure bet that the weapons went to destruction more than a year ago.

                If it was the guns which were confiscated two years ago, they were destroyed long ago.

                What makes you think any Law Enforcement Agency would return rifles which would still be considered as "assault weapons" under CA law to you?

                So they release them to you then arrest you again for possessing them?

                LOL...

                That would be like asking how to get your kilo of cocaine back after you served time for possessing it...

                  The Steps:
                  1, Move out of California and maintain residency in other said state.
                  2, Make sure that you are not exempt.
                  3, Purchase, new to you, firearms.

                    I had a friend who missed the RAW deadline, and when he tried to register them the DOJ adamantly said NO, and told him to surrender, destroy or send out of state. He drove them to Reno and sold to a co-worker who retired and left CA.
                    Losing a $750-$1500 rifle because it wasn't registered is a lot cheaper than had you been prosecuted for possessing it.
                    Some of the punishments for firearms violations could be a 10 year, or even lifetime ban on owning ANY firearm.

                              A different take since you didn't say you need them to come back to you. This is something I'm doing something similar for a customer right now.

                              1) Contact the PD
                              2) Find an FFL that will dispose of firearms, in this case, one with an AW permit or one out of state the PD will ship to (unlikely)
                              3) Pay lots of money, have local FFL with AW permit pickup and dispose or pay PD to ship to FFL out of state

                              Now I have no idea if PD will ship, but it is a legal option.

                              I have to do this for a customer whose guns got seized (4 of them), but he only cares about 2 of them (expensive shotguns) which I am picking up on his behalf and shipping to an FFL in NY who will then be exporting them to his son in England. All the appropriate laws get followed and he doesn't lose his 10k shotguns to the smelter. He had to do this now because he's on a restraining order (not perma ban), but the PD wasn't going to hold them much longer before destroying.

                              Also, these aren't AWs so I, as a regular FFL can go handle this.

                              So there is an option, assuming the firearms are available still, but it requires the PD being willing to do something to dispose of them for you. Just being prohibited (either temporary or permanently) I suspect isn't a deal breaker since they are going to push the liability ultimately to the FFL to follow the appropriate laws to dispose.

                              I had another instance where a customer (TRO) was transferring all the firearms to his cousin. Wasn't an issue for PD as long as I followed all the appropriate laws. Some items were handguns so I had the TRO customer come in to do the PPT paperwork. I also had him confirm that if for some reason his cousin didn't pass/forget to pick up that the only option would be for me to release to Fremont PD for disposal since I knew it could not be returned to him.
