    Gun buying question

    A friend of mine is selling his AK, I am thinking about buying it.
    However, (for some reason) he registered it as assault-weapon
    My question(s) are:
    Can I buy it?
    If so is just a normal transaction or it some special process?

    If it was a registered assault weapon, there is no buying it in CA.

      You can not buy it and he can not legally sell it in California to anyone but a special FFL.

              Even though post ban (Roberti Roos), they later put MAK 90 on the ban list. Legal for him as RAW but he can't sell to you. He can sell IT in NV or other state.

              ( some will say if it says sporter it's legal... even though it says Norinco and made in China).

              Doubt any FFL will agree.

                It is a make/model banned RAW.

                Therefore, it can only be sold to:
                A. a CA FFL dealer with assault weapons permit.
                B. a non-resident of CA and transferred through a FFL dealer in the State the non-resident lives in.

                Since it is make/model banned, the only method to deregister it is to destroy the receiver, per BATFE specifications, and provide CA DOJ proof of destruction, as part of the request to deregister it. After CA DOJ approves the deregistration request, the parts can then be sold to you and you can use the parts to make a new firearm that is CA legal.
