Has the California Hand Gun Rooster restrictions been challenged in court yet? I thought that firearms in "common use" had been allowed by the Supreme Court. It seems to me that the rooster nullifies this. Certainly guns once on the list, but removed because the maker no longer wants to pay the fee could be considered common use firearms.
by taking guns off the list do to the maker no longer reupping the fee for relisting, this makes purchase or inheritance of older, used firearms not legal.
It seems to me the rooster, specially the requirement of a maintenance fee to keep a gun on the list does does violate the common use rule. Also the fact that law enforcement can buy these off list guns for personal use seems to make these off list guns common use.
