    Interstate intrafamilial AR Pistol gift

    Is it allowed? Assuming it has an approved fixed magazine device installed?

    Inter familial gifting gets you around the roster, and as long as it’s compliant with AW laws and you have an FFL that will accept it - have at it!

      ^ the second part is as key as the first. Just because it IS compliant, doesn't mean many FFL's will touch it.

      CADOJ has buffaloed many FFL's into being very conservative with what they will transfer, for fear of excessive scrutiny towards their business.

      Find an FFL that knows what they're doing. You'll need to have it made compliant before it enters CA. There are some good third parties out there (like audiophil in AZ), who will do that service and may be able to help persuade your local FFL to accept the transfer from him.

        My son lives in Idaho and wants tio gift me an ar stripped pistol lower. Can this be done or must it be assembled as fixed mag lower first. No I thinks please.

          I think it needs to be completed, or at minimum with a fixed magazine. Complete enough to do that safety test mumbo-jumbo?

            yes it needs to be a completed pistol that has the fixed magazine (bullet button version '2.0'.

            your son should send it complete..then once you pick it up after 10days and have another pistol upper and fixed mag to put in, send him his parts back.

                Depends on how it is DROS'd.

                If it is DROS'd as a "handgun, pistol, receiver/frame", then it can be used to legally make a dimensionally compliant bolt-action single-shot pistol.'
                ^Per CA DOJ, it will need to remain configured as such, in order to remain CA legal.

                If it is DROS'd as a "handgun, pistol, semi-auto" or "handgun, pistol, semi-auto, receiver/frame", then it can be used to legally make a semi-auto pistol with a fixed 10 round magazine.
