    California Tax Stamp (SBR)

    Does anyone here know if you can still obtain a Tax Stamp for an SBR rifle? I first hard today that you could. I also heard you couldn't get one in California.

    Can someone clear this matter up for me? Also, if you have one, what was your experience and wait time to complete the paperwork and background?

      SBR/SBS are generally illegal because of the NFA without a tax stamp but they are ALSO illegal because of California law.

      I think there is other Penal codes that ban them as well.

              You can get a stamped SBR as long as it was stamped 50yrs+ ago to be considered a C&R, which there is an exemption in CA for. Very few and far between. For reference CA PC 17705 lists the exemption to CA pc16590 which covers NFA stuff and PC 33215 which covers SBR/SBS stuff.

                In order to legally obtain a Title 2 SBR, you must comply with Federal and State laws/regulations.

                In order to legally possess a SBR in CA, you must have a valid CA DOJ Dangerous Weapons Permit for a SBR.

                BATFE will not approve a Form 1 or Form 4 for a CA resident, unless the applicant has a valid CA DOJ Dangerous Weapons Permit.

                In order to obtain a Dangerous Weapons Permit for a SBR, you need a good cause. [PC 33300(a)]
                There are only two viable good cause of issuance of a Dangerous Weapons Permit for a SBR/SBS. [PC 33300(b)]
                1. For use as a prop in the entertainment industry. [PC 33300(b)(1)]
                2. For making/transferring to a Gov/Mil/LE agency. [PC 33300(b)(2)]

                If your good cause does not fit one of those two categories, you will not be issued a Dangerous Weapons Permit for a SBR.
                Which means you can not legally own/possess a SBR in CA.

                If you do get issued a Dangerous Weapons Permit for a SBR and you use the SBR in a manner that is beyond the good cause for issuance (self-defense, informal shooting, competition shooting, etc) or store it in an unregistered non-approved location or transport it in an unregistered non-approved vehicle, then that is grounds for revokation of your Dangerous Weapons Permit and confiscation of your SBR. [PC 33315]

                C&R SBR and C&R SBS are exempt from requiring a Dangerous Weapons Permit for them to be CA legal. [PC 17705(a)]

                          Ha! Thanks. Yeah it looks a little odd like that but once the can is on there's no worries of muzzle blast or anything and it looks right. Pretty much decided to keep this rig dedicated to that suppressor and will run it as such.
