    Does 1 in 30 days apply

    My father lives out of state, and is driving to CA this summer with me. He wants to gift multiple guns to me including handguns and long guns. Does the 1 and 30 rule apply to these transfers? What is the best way to accomplish this? I have a good CA FFL that I work with.

    www.shipmygun.com and a ca ffl that knows how to do inter-state intra-familial transfers.

          I did a lot of research on this before I was eventually able to figure it out. For an interfamily transfer from another state into CA to be legal the handgun has to be shipped from one out of state FFL to an California FFL.

            Close, but no cigar senior.

            GCA-68 only requires a FFL in the receiving state to do the transfer. They don't care how it gets there. Or who sends or carries it there.

              Hopefully research is not your day job

              As noted in the post above, the only requirement is that it gets to a CA FFL. How it gets there does not matter, not to the state and not to the feds so long as it gets there legally, and there are many legal ways for it to get there that does not involve another FFL and/or any shipping.

              Planes, trains, and automobiles....

                Well to be fair to my “research”, if no local FFL will take delivery unless it comes from another FFL, that ends up being my only legal option lol.

                  Now that is true. What is legal and what is possible are frequently two different things, especially in this state.

                  These transfers depend on having a good relationship with a knowledgeable and familiar FFL. Some FFLs wont touch these at all and some will only handle them according to strict policies, which sometimes result from a misunderstanding of the laws (surprise!) and other times just minimizing exposure to shenanigans on the part of DOJ or the customers.

                    I actually found more than one FFL that knew it was a legal transaction and how to do them but still refused believing it would bring extra attention from the state.

                        An intra-familial gift between CA residents is exempt from needing to be transferred through a CA FFL dealer.
                        Because, a CA FFL dealer is not involved, there is no 1 in 30 day wait.

                        Because an out-of-state intra-familial gift needs to be transferred through a CA FFL dealer (in order to comply with Federal laws), the 1 in 30 day wait applies.
                        ^There is no intra-familial gift exemption to the 1 in 30 day wait. [PC 27535(b)]

                          You should be asking the ffl that you will be using .
                          Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.

                            That might be their policy, but it's not the law and it's certainly not the case with GOOD FFL's.
                            Sounds like all you checked with were BAD FFL's...

                              California law doesn't require the shipment to originate with an FFL. It is perfectly acceptable for an individual to mail or walk it in to the receiving California FFL.

                              I have seen some California FFLs want a copy of the sender's drivers license for verification purposes, but I don't believe that even this is required by law.

                              And personally, my father-in-law (a resident of another state) has gifted my wife a pistol by walking with her into a California FFL and doing the correct transfer.
