    What's the hurry?

What is the hurry on purchasing large capacity mags? Is this a very short term opportunity?

Yes, if a stay is issued, sales will stop.

It very well may be. Then again, maybe not.

Most fear that Judge Benitez will issue a stay on his ruling (or a partial stay that allows the state to enforce the prohibition on purchasing, transferring, importing, manufacturing, etc. but not mere possession) pending the state's appeal to the 9th circuit court of appeals. The 9th has, to put it mildly, not taken an expansive view of 2A rights. The fear is that a stay will issue, either from Benitez or from the 9th; then months an months will pass before the 9th renders a decision on the appeal; and if the 9th overturns the ruling, that it might be very dicey getting a supreme court hearing -- which in any event, would be years down the road.

So people are trying to acquire magazines now, in the window between Judge Benitez's ruling permitting the acquisition, and a potential stay that reverts everything to status quo for at best a lengthy period.

Why would Benitez issue stay? He declared the ban unconstitutional. Has the constitution changed since last week?

Not going to rehash the million different discussions of this very issue that have been ongoing for a couple of days.

I'd just say that a US District Judge understands that his/her decision is not final, and appraises the nature of the request for a stay and the implications of the potential harms to both parties on opposite sides of the issue of a stay. All with knowledge that, oh maybe every once in a blue moon, an appeals court reaches a decision that differs from the district judge's view.
