My guess is that the reinstatement (stay) will not happen at all. The state’s only argument for the stay is to keep the status quo of the past two decades, but it is a status quo that the state artificially created by making laws that run afoul to the US Constitution.

It would be like if I stole your car and then you find me driving it, sue me to get it back and win. And then I tell the court I want to stay the judgment, so I should get to keep driving your car to preserve the status quo during my appeal.

I never thought I would ever see California go thru with this ruling in my life time. I felt FREE and almost teary-eyed when I read the news on Friday. God Bless America and people like Honorable Judge Benitez who has common sense.

              IMO...

CA AG filed and is asking for an emergency stay to be issued between 04-02-19 and 04-05-19.

But, he had to ask this from the Judge that issued the ruling.

The Judge can take his time in denying the request, which, after he denies it, then bumps it to the Ninth Circuit Court of Appeals.

So, there's still weeks before a Court can or will issue a stay.

IMHO, the worst the DOJ could do is tell vendors to not ship orders once a stay is granted. Until then they can only rend their garments and gnash their teeth.

This is true for magazines because restriction was ruled unconstitutional.

This is exactly what they did with the "AW" ban. Legally purchased prior to December 31, 2016 and deemed illegal 1/1/2017. Communists don't believe in ex-post facto law.

The magazine ruling should set the groundwork for declaring the "AW" ban, roster and ammo purchase restrictions all unconstitutional.
