I Dros'd a U.S.G.I. rifle last Saturday and received a call Monday with the FFL stating that is was in "Delay". I have Dros'd numerous firearms this year and actually picked one up on the 6th that I had done 10 days prior. I also started another one for a pistol a couple days ago and have heard nothing negative yet. The info on the forms all looked good with the exception of the FFL put down the manufacture of the barrel and not the name on the receiver as it was blocked by the rear sight. The unfortunate thing is I now found out the ffl will not release on a "undetermined " but said they would do another dros after 30 days if it came to that and try again. I do not see how it is on my end because of the previous Dros's and the current one in process now . Are there any options at this point?

Seeing how they potentially caused the issue, you might have an argument in your near future. -
I thought delayed DROS could be sold after so many days. I have purchased many firearms here in Ca. and never had a delay (that I knew about), but twice I tried to buy from CMP and got a delay both times. The CMP charter (which is granted by Congress) does not allow the sale to take place under "delay".
I would think that if the manufacturer was listed erroneously that would flag for deny.
Is this rifle an M1 Carbine? Lots of shenanigans happened with hand stamped receivers.Comment

Why don't you ask your FFL why he can't release the rifle on the delay per federal law...
In open transactions, the FFL may record on line 21c of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Form 4473 “delayed” and the date provided on which the firearm may be lawfully transferred under federal law if a final determination of proceed or denied is not received from the NICS Section.
If the FFL has not received a final determination from the NICS after three business days have elapsed since the delay response, it is within the FFL’s discretion whether or not to transfer the firearm (if state law permits the transfer). If the FFL transfers the firearm, the FFL must check “no resolution was provided within three business days” on line 21d of the ATF Form 4473.

The origin al 10 day wait isn't until the 12th. I did ask if they would release under delay or undetermined and the answer was no due to their store policy. At this point I am hoping it will unravel itself here soon. I too have purchased many thru PPT and quite a few new ones in the last several years with no issues at all. My plan was to drive back to the ffl (2 hours) after the 10 days is up and start some dialogue on this.Comment

These delays happen sometimes for no particular reason, sometimes for a name mix up (if you have a common name) or sometimes there is some sort of adjudicated thing from someones past that gets flagged for further review, and the FBI is backed up with these checks, so the delay just runs and runs.Comment
