Sir,

Please give a close read to Senate Bill 1235 from the last legislative session, and to the resulting Penal Code section 30356(b).

There is no requirement that you own, or have registered in your name, a weapon of the caliber that you seek to purchase ammunition for. Someone at your local gun store is making something up here.

However, there is a new requirement that the ammunition purchaser's "" match an existing record in the state DOJ's Automated Firearm System. Please note the absence of any requirement for a weapon caliber match to that of the ammunition purchased.

You have correctly identified the potential for an active duty military member to lawfully possess firearms in the state that they cannot lawfully purchase ammunition for. California has a lot of laws that don't make empirical sense. Add this one to the list. It ain't gonna change nothing.

^This would be done every time, the person transfers ammo through a licensed ammunition vendor.



Penal Code 30370
(a) Commencing July 1, 2019, the department shall electronically approve the purchase or transfer of ammunition through a vendor, as defined in Section 16151, except as otherwise specified. This approval shall occur at the time of purchase or transfer, prior to the purchaser or transferee taking possession of the ammunition. Pursuant to the authorization specified in paragraph (1) of subdivision (c) of Section 30352, the following persons are authorized to purchase ammunition:
(3) A purchaser or transferee who is not prohibited from purchasing or possessing ammunition in a single ammunition transaction or purchase made pursuant to the procedure developed pursuant to subdivision (c).
(c) The department shall develop a procedure in which a person who is not prohibited from purchasing or possessing ammunition may be approved for a single ammunition transaction or purchase. The department shall recover the cost of processing and regulatory and enforcement activities related to this section by charging the ammunition transaction or purchase applicant a fee not to exceed the fee charged for the department’s Dealers’ Record of Sale (DROS) process, as described in Section 28225 and not to exceed the department’s reasonable costs.

One-time ammunition purchases or transfers may be completed using a Basic Ammunition Eligibility Check.
(a) As authorized by Penal Code section 30370, subdivision (c), the fee for a Basic Ammunition Eligibility Check is $19.00.
(b) The ammunition vendor shall collect the ammunition purchaser’s or transferee’s name, date of birth, current address, gender, hair color, eye color, height, weight, and driver license or other government identification number, in the manner described in Penal Code section 28180, and telephone number, United States citizenship status, federal Alien Registration Number or I94 (if applicable), place of birth, alias name(s), race, and enter this information into the DES website.
(c) The ammunition vendor will provide the purchaser or transferee an ATN to monitor the status of the Basic Ammunition Eligibility Check through the Department’s CFARS website.
(1) An approved Basic Ammunition Eligibility Check can only be used for one
ammunition purchase or transfer, and the approval expires 30-calendar days from when it is issued.
(2) If the Basic Ammunition Eligibility Check is denied, the Department shall notify the purchaser or transferee of the reason for the denial via U.S. Mail.
(d) Upon the Department’s completion of a Basic Ammunition Eligibility Check, the Department shall update the purchaser’s or transferee’s DES record. The ammunition vendor shall deliver the ammunition to the purchaser or transferee only if the status of the Basic Ammunition Eligibility Check is “Approved.”

Unfortunately I joined the Navy; the least gun-friendly of the services. I’ve never seen a NEX that carries firearms. A $19 fee every time I buy ammo seems ridiculous; “shall not be infringed...”

That's alright at least you're serving haha. But if you're ever by Pendleton check out the MCX at the main gate. Worth a shot at least.

Or, do I give the info, pay $19.00 once, get approved and then I am good any time I go to a store to buy ammo?
