See attached.
This is a straightforward unlicensed, unserialized SBR case. Nothing to see here.Attached FilesIn case it wasn't obvious, nothing I write here should be interpreted as legal advice.Comment

Or no butt stock
They always go in numbers divisable by 12. It's easier to bring the donuts that way.Last edited by M1NM; 09-07-2018, 8:44 PM.Comment

We still have no evidence it was an SBR.. could easily be a brace.
Looking at the indictment he had 10 round hex mags.. find it oddly
Curious that he has an sbr but only 10 round mags. It’s like paying the parking meter before robbing a bank.
I’m which case only the serialization issue which isn’t an issue as he has until 2019 to complete the DOJ provided serial number process

The only charges mentioned are federal ones. Federal government doesn't charge for state crimes. Having an unserialized firearm is generally legal under federal law--although having an unserialized SBR is an exception to that general rule.In case it wasn't obvious, nothing I write here should be interpreted as legal advice.Comment

Theoretically possible, but extremely unlikely given the ATF interpretation. Federal prosecutors aren't idiot, third-tier law school district attorneys. They are very smart and they don't bring charges that won't stick. In case it wasn't obvious, nothing I write here should be interpreted as legal advice.Comment

Why does it take that much salary.
More than a dozen investigators from FBI executed a search warrant on Gordon's property on Tamalpais Road early Thursday morning.Rule 1- ALL GUNS ARE ALWAYS LOADED
Rule 2 -NEVER LET THE MUZZLE COVER ANYTHING YOU ARE NOT PREPARED TO DESTROY (including your hands and legs)
Rule 3 -KEEP YOUR FINGER OFF THE TRIGGER UNTIL YOUR SIGHTS ARE ON THE TARGET
Rule 4 -BE SURE OF YOUR TARGET AND WHAT IS BEYOND IT

Sure they do. That's one of their tactics, to overwhelm and scare defense attorneys. They cook up every charge they can think of. Plus, if it goes to trial, and the guy in convicted of one charge and not guilty on three, when it comes to sentencing, the guidelines allow for the not-guilty counts to be used against him.Comment

Sure--except if it's a brace, none of the charges stick. Each charge relies on the firearm being a rifle, which it is not according to the federal government if it has a brace (and was never previously a rifle). So your point is inapposite here.Sure they do. That's one of their tactics, to overwhelm and scare defense attorneys. They cook up every charge they can think of. Plus, if it goes to trial, and the guy in convicted of one charge and not guilty on three, when it comes to sentencing, the guidelines allow for the not-guilty counts to be used against him.
Anyway, betting is a tax on BS: I'll bet you fifty bucks to the 2A organization of the winner's choice that this firearm did not have a brace on it.In case it wasn't obvious, nothing I write here should be interpreted as legal advice.Comment
