Thanks for the comments. I got more education than I bargained for. To summarize:

It's legal to buy Tannerite in California but it's use requires a license. Citations here.

The manufacturer of Tannerite claims it won't start fires but apparently any impurities in one or the other component (such as Coffeemate) could lead to a fire.

Neither the National Forest Service nor the BLM allow exploding targets on the lands they administer due to the fire risk.

The next time I see this guy I'm going to try to convince him that he needs to do a little more homework or risk big trouble. If he's not receptive, well that's gonna be his problem. The reason shooting spots are getting shut down everywhere (not just California) is because there are too many people who lack common sense and think rules are for suckers, and too few of us who are willing to speak up about it.

Your Honor, my client purchased tannerite with the intent of using the aluminum/zirconium powder mix as glitter for a ceramic unicorn collection. The ammonium nitrate portion was to be used as fertilizer for the flower garden.

As a juror, I may accept this as reasonable doubt. Not to sure about the 11 others sitting next me.

Is it being legally sold in CA? Or, is it that the vendors haven't been cited yet? I really don't know nor do I care. Either way, it is illegal to possess with the intent to make an explosive (as defined by CA law). I can't answer how a DA will be able to prove intent in every case but, I'm not willing to break the law by taking the risk that I might be able to worm my way out if it. Are you?
