    State lawmakers are warning that a federal appeals court decision striking down state restrictions on who can carry a firearm in public could make Hawaii a more dangerous place to live.


    The level of butt-hurt Hawaii officials display in this piece is epic. They are urging filing for en Banc and are stomping hard with both feet!

          That was because the SCOTUS was pretty much split maybe slightly liberal. They were waiting for HRC to appoint more nutjob liberal activist justices so they could eviscerate the 2A. But Americans woke up and elected Trump just in the nick of time and when Kavanagh is confirmed the SCOTUS will be solidly conservative and in a position to take gun rights cases. It was all strategy, but that strategy has back fired because Trump was elected.

              Open carry makes the public nervous. I think that this may cause CC permits to be issued instead in the "May" counties which are actually the hardly ever counties.
              I'd agree with you but then we'd both be wrong...

                The court and our nation's history have over 200 years of jurisprudence. Avoiding 2A cases isn't a new thing.It has nothing to do with a split. It's just something the elites that sit on the court don't really care about, never have, never will.

                    The SCOTUS has been reluctant to hear cases because the lower courts were doing just fine eviscerating the 2A on their own. But now with a more conservative tilt and more pressure than ever to clarify gun rights, I would not be suprised in the slightest if the SCOTUS starts hearing cases like they should have been all those years. If there ever is a time when they would be open to hearing gun rights cases it is going to be in the near future. There's just too much public outcry on the subject from both sides. I'd bet there is a better chance they make a major 2A ruling than to reverse Roe V Wade.

                    Another thing, the liberal justices must be aware that they would be forced to apply strict scrutiny to any unconstitutional gun laws that make it up to them. Whereas the lower courts can go ahead and ignore strict scrutiny when deciding if something is unconstitutional. Just more reason for them to avoid 2A cases. Something will most likely change when the court becomes more "conservative".

                        I dont see this as a true win. Shall issue ccw is much better. Walking around with a gun on your hip exposed makes you a target to criminals. I personally wouldn't ever open carry unless I was hiking. But I do live in a county that issues ccw liberally.

                          It will be a few months before we know it this is a true win but its a good start.
                          I agree walking around with a gun openly strapped to my side in many public places might not be my preferred method of carry but there a lot of places I would carry openly such as in my vehicle. It would also be nice to be able to carry owb without fear of being exposed or printing.

                            Yes in your car would be nice I agree but if you are carrying owb without printing or being exposed then you are concealed carrying.

                              The court is just jerking people around if they were really serious they would have ruled that HI could not stop anyone from carrying in any manner they choose if they can pass a federal background check. There is no reason to allow open carry as opposed to concealed carry, anyone with criminal intent will carry the way that works for them no matter what the law is.

                                Not quit what I was saying. If OC becomes legal I would still prefer to CC in most public places but in some situations I would not be as concerned about printing or accidental exposure. Like maybe an buttoned shirt or T Shirt that might be a little short and momentarily expose my cc. I live in the country and there are lots of times I might OC while out farming or around outside the home doing chores.
