    I vote that the OP pay each forum member that read this thread $1.00 in compensation for wasting their time. That will teach him to quit running to the internet to get sympathy and validation.

      You can argue anything you want. While fraud is a crime, based on the information provided there is no fraud. Breach of contract - - possible, but most certainly not a crime.

      It appears the op is the one in breach of contract, not the seller.

        I wouldn't. The point of the deposit is that you are paying someone to hold the gun for you. If you back out of the deal after they held it for you, the deposit should be gone.

        That being said, if I'm holding a deposit on one of my gun's for someone, I'm sure as heck going to be immediately responsive since they already have paid me money.

          Not gun related, but similar as far as deposits go.

          I found a guitar maker to build my acoustic. He was very up front in writing about the deposit, which was $1K.

          Non-refundable.

          If I backed out... gone-bye-bye.

          Two years later, after the instrument was built, I paid the balance and have my guitar.

          That is the way I would operate if I was selling something. The person who paid the deposit would have the 'right of first refusal' with a mutually agreed upon date for the balance of the purchase.

          Any agreements would be in writing.

          If they failed to communicate and provide the balance by the due date, and after notice by me, the item would be again up for sale, and the deposit would not be refundable.

          Just seems like good business to me.

            TBQH I actually did put a deposit down on a gun once. A 1911 by Springfield Armory that isn't really being massed produced. Eventually the 6 months wait turn into an indefinite wait, and the store ended up going out of business(probably one of the better stores in Fresno, RIP) so they refunded me my deposit. Also I kinda changed my mind about the SA itself after they got caught supporting anti-2a groups. Needless to say I lucked out.
