    Out of state purchase

    Hi, if I attend an out of state auction and purchase say a revolver an d a rifle that were made before Calif even had a roster can they be brought in still? Someone was telling me no. Others say yes. I know they would still need to be shipped to my for after getting DOJ permission.

        C&R handgun is ok - if you have 003 and COE. I think

          If it is single action revolver with 3"+ barrel and 7.5" OAL, or any handgun made 50+ years ago or on the ATF C&R list - you can have those shipped to a CA FFL for transfer to you.

          If you have a C&R license / 03 FFL (no COE required) you can bring back any C&R listed handgun / long-gun or 50+yr old handgun / long-gun with you, no need to ship to FFL.

            Whenever I buy a firearm from out side of CA, I ALWAYS print out the hard copy of the firearm detail/description/advertisement to the CA FFL that I am going doing the business with and listen to them to tell me can I buy that firearm or not.
            You can buy or bid any firearm from any state, but if your local CA FFL can not do the DROS then you will be a big time screw.

              Since "Someone told me it was OK on the interwebz" is not a valid legal defense, I suggest the following:

              1.) Try using a search engine and at least 15 min. to look for your answer and get a general idea of the risk involved in making a choice with possible legal ramifications...
              2.) Gage your level of acceptable risk. If being wrong equates to possible prison time, and that is not a risk you find amenable...then your question is answered.
              3.) When posting a question regarding CA laws and possible violation thereof, make an authentic effort to state your question clearly, and with minimal grammatical obscurity if you hope for an actual informative response. Some rifles are legal, others are not. Be specific...
              4.) If you think it is probably a bad idea...it is probably a bad idea...

                  Federal laws prohibits a person from acquiring a firearm in a State they do not reside in, unless a FFL is utilized. [18 USC 922(a)(3)&(5)]
                  ^Failure to utilize a FFL equates to a Federal felony for everyone involved with the transfer.

                  CA laws requries CA residents to have firearms they acquire outside of CA to be transferred to them through a CA FFL dealer. [PC 27585(a)]
                  ^Exemption for CA resident with a C&R FFL acquiring a C&R firearm while physically in another State. [PC 27585(b)(1)]

                  This means...

                  It is legal for a CA resident to buy a firearm while in another State, but it is illegal for that CA resident to take possession of it.
                  ^Unless the CA resident has a C&R FFL and is acquiring a C&R firearm.

                  After the CA resident buys the firearm, the seller must ship it to a CA FFL dealer.

                  After the CA FFL dealer recieves the firearm, they will then transfer (4473/DROS/10 day wait/1 in 30 day wait) it to the CA resident.

                  The firearm must be CA legal (can not be considered an assault weapon or generally prohibited weapon) and can not include any large capacity magazines.

                  If the firearm is a handgun, then it must be listed on the Roster of Handguns Certified for Sale or be exempt from it (C&R, LEO, OTP, SAE, SSE2).
