    Consequences of an accident....

This is a "what if" question.

What if a person was out hunting solo in CA, and he accidentally shot himself in the foot?

Lets assume he either drives himself to an ER, or gets medical transport.
Lets assume he comes out OK, medically.

What would the state of CA then do to that person's gun rights?

For the sake of argument, assume everything he did (hunting license, legal location, legal animals to take, legal season, legal ownership, legal guns, legal ammo....) up until the point of shooting himself in the foot, was correct and proper and legal.

I realize that if I asked this question in some place like Florida or Kentucky, people would look at me like I was crazy. But we're talking California here.

Common sense would/should indicate- nothing. But then, that goes out the window in Ca. because when it comes to gun legislation, there isn't any such thing.

Probably try to make the person a "prohibited type". Maybe arrest the person for assault with a deadly weapon.

^^ Nonsense AD cops will fill out report. Better be out in field and not in vehicle when it occurs. Less explaining to do.

I'm unclear on whether they took all of his guns from him or, just the ones that he had with him in the car?

          Sounds like it's the former.

Yes, just the ones he had with him. They didn't come take all his guns, and what they did take he got back. No crime, no loss of property or freedom. Even in CA, no matter how much DeLeon the Tiny would like it to be otherwise.

Why would anything happen? It's called an accident.

I would plan on the incident being treated as an accident by responding LEO's.

If you are transported for medical care, plan the responding officers securing your weapons for safekeeping while you are receiving such care. The downside is that the law requires you to go through the LEGR release procedure to get them back.

It is technically possible to be charged with the "Reckless Discharge" of a firearm (Penal Code section 246.3), but the LEO would have to show that the discharge was "willful". That element is kinda hard to show in an accidental shooting. There is an interesting aspect to the elements of 246.3 PC. One of them is that discharge of the firearm be grossly negligent and have the potential to cause death or injury to a person. This is significantly different from having the potential to cause death or injury to another person. The fact that you shot yourself in the foot pretty much satisfies this element.

I 'm not real fond of having a round in the chamber until I'm ready to shoot, especially after stumbling on a hunt last spring. I guess that makes me a pu**y but no animal is worth an accident.

Years ago I had an ammo accident. I had a rifle out at the time. The police showed up with the FD, took down the info, ran the rifle's s/n, wished me a get well soon, and left. That was it. Depending on where you live, you'll probably get the same treatment.
