Unfortunately, all they have to do is prove that the bumpstock was intended to be and successfully used as a "work around" of NFA restrictions. The bumpstock is NOT a firearm and therefore probably not protected by the Protection of Lawful Commerce in Arms Act.

Actually the law covers components and ammo etc. as well. In regards to videos I guess a rebuttal could be this video
