    Technical question

    If the upper and lower are separated. AR type, is it fine to have a regular mag release?

    Reason I'm selling one of my ARs probably to someone out of state to a FFL. So should I take the whole mag release off, spring -button -and lever arm and put these in a bag. With a pistol grip still on. Or is it fine just separate in two. I was thinking of wrapping upper and lower with some bubble wrap or paper in the same rifle hard case.

        i'm not sure what the legalities are for selling out of state. but if you were selling in state, i think you would need to make the lower entirely featureless in order to sell with a standard mag release... so remove the pistol grip or add a grip fin, in addition to a fixed stock, etc...

          By the letter of the law a complete lower by itself is not considered an AW so selling it with all the features should be legal. If you run a Rimfire upper or centerfire manual pull or bolt action upper you can legally run a standard lower.

          Now if you or the buyer plan to run a center fire that is semi auto you will need to change it to featureless at this point or a true fixed mag. At least this is the way I understand it. This is not legal advise so take it for it is

            Yes.
            With it being disassembled, it does not meet the definition of an assault weapon.



            However, if doing this for storage to avoid assault weapons registration/compliance, it is prudent to store the parts in seperate containers/locations due to previous CA convictions for "broken/contructive" assault weapons.

              Ok. I want to sell off the stuff I bought last summer that I was thinking of registering.

              Want to keep a collectors edition and go fixed mag. Don't plan to shoot it much obviously.

              I don't shoot much and I can use the funds to pay bills, start businesses, fix my bikes, etc.
