    Off roster private transfer question

    I'm new to Calguns so if I'm doing something wrong please let me know. My father lives in Maryland for work and officially lives in Arizona. Bought a sig p320 which I know I can't buy here but he said he's willing to transfer it to me. From my understanding from father to son transfer is legal even though the gun is off roster here in California correct? And also, if it can be done, once I have the sig will I be able to add it to my CCW if it's an off roster firearm?? Thanks in advance.

      to add to that, it has to be transferred through a FFL that understands intrafamilial out of state transfers. If any FFL tells you to fill out a form and pay $19, RUN AWAY to prevent becoming a felon.

        From what I've read my father would have to fill out a transfer form with my firearm safety certificate number on it and say that it was a gift to myself and pay the fee for the transfer is that not correct munkeeboi?

          That is not correct. Federal law requires that your father ship the gun to an FFL in California. The FFL will transfer the gun to you with all the usual formalities (DROS, 4473, ten day waiting period). The FFL will charge a fee for all that.

          Many FFLs don't understand the process. You need to find an FFL who understands the law, and you need to work out the details, including the FFL's fee, ahead of time.

            And, if an FFL you contact says 'use the form', that one does not understand interstate intrafamilial transfer - find another one.

            Tell us where you are geographically and you may get specific shops to try.

                I understand that some counties do not allow off roster weapons on their CCW permits.

                    Anyone know of an FFL near the San Fernando Valley that knows how to do an interstate-intrafamilial transfer?

                    I was going to use Guns Direct in Burbank but I just called and heard some different information then I was originally told. Great people there, but I simply don't want to risk the chance of the transfer being done incorrectly. They also said that if i had the weapon in-hand already, then I would just have to fill out a form. Sounded iffy.

                    Also, is it common for an FFL in California to refuse a gun shipped to them directly from an out of state family member via Fedex or UPS? I was now told that they require the out of state family member to use a FFL in their state to pack the gun and ship it them.

                      It is up to the receiving FFL if they will accept shipments from non-licensees. There is no law that prevents them from doing so, but some will not.

                        Rafael at Get a Gun in Bako will almost certainly do the Intrafamilial transfer at a reasonable rate. I have purchased several guns on-line and this transfer fee was $50 and that included DROS.

                          2A Zone in Alta Loma (San Bernardino County, off the 210 fwy) can facilitate out-of-state intra-familial gift transfers.

                          The info they gave conforms to CA laws as it applies if all the parties involved are CA residents.

                          Since one of the parties involved are non-CA residents, Federal laws requires the use of a CA FFL dealer.
                          As per Federal laws, failure to utilize a FFL equates to a Federal felony for everyone involved with the transfer.

                          There are no laws mandating a firearm must be shipped by a FFL.
                          Therefore, it is up to the individual FFL to decide on if they will accept a shipment from a private party or FFLs only.
