    Selling deceased Nephews rifle?

My Sister's son passed away this last week and she told me she doesn't want to keep his Ruger 10/22 Carbine. He had just recently purchased it as part of his bucket list but sadly didn't even get the chance to shoot it as his cancer just took off and consumed him.

She has a notarized will leaving all his possessions to her and has durable Power of Attorney. How does she go about selling the rifle?

    Thanks - Dave

          Thanks, Manny

Still looking for knowledgeable advice as to how my Sister needs to go about selling the rifle. Being it is not registered in her name, I'm fairly certain there will be additional hoops to jump through and/or forms to fill out.

My condolences OP, I saw the previous thread too late, and I'm sorry for you and your sister's loss.

You should contact the DOJ for sure to prevent any complications with the paperwork, but if I remember correctly, if she has power of attorney, she can sign the DRoS and 4473 for him to complete the PPT. She will need to enclose the documentation of the power of attorney, and also bring both his and her ID for the FFL to copy. Make sure that she brings the original copy of the power of attorney letter, and I believe there needs to be something that was notarized as part of the documentation, but it's been years since I went through this.

            Hope that helps.

            Jerry

easiest is going to the local gun store and ask what she needs to do.
most likely she can sell it, by showing the gun store all her paperwork and sell as PPT. just advertise here on calguns as PPT estate sale. no shipping.
Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.
I really miss the good old Pomona Gun Shows.
