Have lock receipt, no lock, gtg?

I bought a rifle and a lock 3 weeks ago, i returned the lock. Im picking up a different gun at a different shop tomorrow, should the receipt get me out the door?

Only the receipt has always worked for me. Although some dealers will have you fill out the safe affidavit.

i believe you can get free locks from your local PD

It's not about the lock itself, but the proof of purchase (within 30 days) that is required. Again, most of the dealers I go to have safe affidavits for me to sign for long guns that will substitute for a CA DOJ approved lock receipt.

IMHO, it's the intent that is important. While the buyer is trying to save about $8, the FFL is trying to save his license.

It's supposed to be the case that the dealer may not deliver without the lock physically present at the time of transfer. Just the receipt will not do; just the lock will not do; you need both.

The 30-day rule is, apparently, intended to ensure that one does not buy just one lock and continue to use that one for all subsequent gun purchases.

(c)(1) All long-gun safes commercially sold or transferred in this state, or manufactured in this state for sale in this state, that do not meet the standards for gun safes adopted pursuant to Section 12088.2 shall be accompanied by the following warning:
"WARNING: This gun safe does not meet the safety standards for gun safes specified in California Penal Code Section 12088.2. It does not satisfy the requirements of Penal Code Section 12088.1, which mandates that all firearms sold in California be accompanied by a firearms safety device or proof of ownership, as required by law, of a gun safe that meets the Section 12088.2 minimum safety standards developed by the California Attorney General."

(2) This warning shall be conspicuously displayed in its entirety on the principal display panel of the gun safe's package, on any descriptive materials that accompany the gun safe, and on a label affixed to the front of the gun safe.
(3) This warning shall be displayed in both English and Spanish in conspicuous and legible type in contrast by typography, layout, or color with other printed matter on the package or descriptive materials in a manner consistent with Part 1500.121 of Title 16 of the Code of Federal Regulations, or successor regulations thereto.
(d) The sale or transfer of a firearm shall be exempt from subdivision (a) if both of the following apply:
(1) The purchaser or transferee owns a gun safe that meets the standards set forth in Section 12088.2. Gun safes shall not be required to be tested, and therefore may meet the standards without appearing on the Department of Justice roster.
(2) The purchaser or transferee presents an original receipt for purchase of the gun safe, or other proof of purchase or ownership of the gun safe as authorized by the Attorney General, to the firearms dealer. (e) The sale or transfer of a firearm shall be exemptfrom subdivision (a) if all of the following apply:
(1) The purchaser or transferee purchases an approved safety device no more than 30 days prior to the day the purchaser or transferee takes possession of the firearm.
(2) The purchaser or transferee presents the approved safety device to the firearms dealer when picking up the firearm.
(3) The purchaser or transferee presents an original receipt to the firearms dealer which shows the date of purchase, the name, and the model number of the safety device.
(4) The firearms dealer verifies that the requirements in (1) to (3), inclusive, have been satisfied.
(5) The firearms dealer maintains a copy of the receipt along with the dealers' record of sales of firearms.

Wes is absolutely correct.
You need to know your FFL is willing to overlook it. You might find yourself hunting down a lock to carry out with you if he doesn't.

Thanks for your responses, I guess i gotta buy a new one. Hopefully they throw one in free like Uncle Pauls Exchange, those guys are cool. Maybe time to start a "Show me your superfluous gun lock collection" thread.

PC says "purchase". Dumb, but there you are. Can you give him a quarter or something and get a receipt for that?

And, the PD has to be distributing 'approved' locks; a gun store can't sell anything else (for use on guns), but I've heard that sometimes PD is passing out UNapproved locks.

I am fairly certain all of the Project Childsafe locks are CA approved. This rumor sounds like a good one for your FFL dealer to start because he doesn't want you bringing in a free lock with a receipt to get out of buying his $15 gun lock.

The 1200 free locks I got from my PD and just hand out with my purchases are all approved.

hmm, that makes for an interesting idea. have some sort of gun lock bin so if you need a lock, you can "purchase" one for a penny when you pick up your gun...

kinda like the "take a penny, leave a penny" tray at the 7-11...
