    Buyer failed dros

    Sold a weapon last week
    Got a call from the buyer, he failed the dros,

    Wants all his cash back?

    All done , received my weapon back, took 50 dollars out for gas, traveling and a headache,

        It didn't DROS out of your name due to the failure. Pick it up at your leisure or walk away. Any refunds are discretionary. Provided you haven't spent it already anyway.

        Not your problem unless you make it one.

          No but really it's not you giving money back to him. It's you buying the gun again, chances are if you wanted it you would not have sold it.

          You are either eligible to buy a firearm or not. If an issue occurred he should sort it out.
          You sold a firearm in good faith, who knows what you did with that money. Did you go buy a Lamborghini? Maybe and I bet if you had to go buy something back from someone you couldn't return the car to do it. Tell him to post it up on calguns. If he lays out the situation I'll meet him and buy it at a deep discount cause he really can't do anything with it and who would want to buy a gun from someone who can't even buy one himself...

                while i don't think you're obligated to do anything, if you do pick up the firearm, the right thing to do is refund "something" to the buyer - im assuming there was no discussion as to what would happen if he failed the DROS

                in the future, when selling a firearm to a stranger, you and the buyer need to come to an agreement how you'll handle any DROS issue which may also include an "undetermined" finding by the DOJ - some shops will release with an undetermined finding, some won't

                after you pick up the firearm a refund minus a fair percentage for your time is appropriate too

                    "He wants all of his cash back"......ah, no. I don't think so. Go pick up your gun, and, if you still have the cash, send him his money back, minus $50 for your troubles (fuel, wear and tear on your car, loss of potential sale to someone else, etc.). That is more than fair.

                      only i don't think he can sell it to you - if the DROS never went through it's not his firearm to resell

                      if anyone is going to do any reselling it would have to be the OP

                          A few good suggestions above. If the FFL is close by, keeping $50 is fair. If not, keep more.

                          Make sure the buyer realizes he is entitled to nothing, you're being kind.

                            Pick it up and refund his money at the same tine. Why worry about having to go to small claims court and losing. Ownership never transferred. Like others said next time put a disclaimer in your ad.

                              How would you lose in court? The buyer bought something he isn't legally allowed to have. California is a buyer beware state.


                              Same as buying a used car and then having buyers remorse. Not the seller's fault.
