C&R private sale with FFL03 + COE

    C&R private sale with FFL03 + COE

    Hi guys, a fellow on Calguns has a C&R eligible rifle to sell, and I want to buy it.

    I have FFL03 + COE, but I've never done purchase with them. So here are my questions:

    1. Can I purchase a C&R rifle from a private party without going through the transfer at a FFL01?
    2. If yes to 1, what procedure/steps are necessary during the purchase of the firearm from that private party?
    3. What does the private party, the seller, need to do?
    4. After the purchase, what do I, the buyer, need to do? How to register the rifle?

    Sorry, I'm a newbie to the C&R world and hopefully someone can help me on this. Thank you in advance.

    First off welcome to the fun world of C&R deals!

    1. Yes
    2. Record the individual name and address. I usually ask for Drivers License. If from another dealer than just use their FFL #.

    ***record the transaction in a "FFL bound book" they are on Amazon for about $10.

    *** give him/her a copy of your FFL03 (signed & dated) and a copy of your COE.

    3. Seller doesn't have to do anything. Although they could fill out a form called "Notice of No Longer in Possessions" if they feel deemed so.

    4. As I stated before you record the name/address etc. then you send in a BOF961 form via mail. OR you can make a login on the CRIS system online and fill it out there. You have 30 DAYS to report the firearm to the DOJ. In this time you can purchase as many C&R rifles as you want. The fee is $19.

      Is name/address of the seller, copy of their DL sufficient for the CRIS registration? Is there more information I need as the buyer from the seller side?

        The BOF961 form does not ask for any information regarding the seller. In the acquired from section you simply check the private party box. You only need the seller info for your bound book.

            So you give a copy of your 03FFL to a non-FFL private party seller?

            Edit: And I found this thread from a search. It should be in the C&R forum, not general gun discussion.

                Thanks, Freedom_shooter.

                It just seems like an insecure thing to do, giving some random dude your FFL certificate. They could then use it themselves and claim they are you. Yeah, they don't have your ID but maybe they could get away without showing ID. I guess I'm just paranoid.

                  Of course anyone can do anything. If they do it then that is considered fraud; and with that being a Federal license I could imagine capital fraud being much worse than other kinds of fraud.

                  You have to conduct yourself like a business. Be open with identity and paperwork. Both sides release names and addresses. So, he has your info and you have his.
