Unsold guns at closing FFL?

    Unsold guns at closing FFL?

    If FFL's can import off-roster guns to sell to roster-exempt people, what would happen those off roster firearms if the FFL is unable to sell them and closes?

    I'm sure that the owner of the FFL could transfer a lot of the remaining inventory into their own name, but what about any off roster handguns, machine guns, suppressors, etc...?

    Probably send them back to the dealers.

          Depends on the exact situation and guns obviously something like machine guns which very few CA FFL's can or do sell is different. However any CA FFL can buy all the non roster handguns they just can't sell them to non roster exempt people so they would mainly need to be sold out of state.

          Is this a specific gun shop or just being curious? I have seen it happen before.

            This thread might get better traction in the FFL section, but last I checked, FFLs still need to abide by the CA roster when transferring dealer inventory to personal inventory.

              Another gun shop buys the inventory e.g. Eddy's in Mountain View was selling off the last of the San Jose Gun Trader stock.

                I'm not talking about a specific gun shop, just in general.
                But the purpose of the thread is what happens if they can't be sold. So selling out of state isn't an option.

                  Generally...

                  If FFL expires and no renewal, then they have 30 days to get rid of their inventory.

                  The firearms are either sold to other FFLs or sold to exempt persons or sold to a distributor at a discount or surrendered to law enforcement for destruction.


                  If FFL is revoked, BATFE takes possession of the inventory.

                    Prior to closing the FFL and distributors make arrangements to send unsold weapons back. The Bound book is kept for inspection upon closing the doors so each and every firearm is accounted for through a DOJ and ATF inspection during the Bankruptcy.

                        Maybe in most cases... But you may want to reread the question...

                        Selling out of state is not possible when when the condition of the question has to do with being unable to sell the guns.

                          Can you be more clear on your question then? What situation would this be where they could not sell the guns themselves, something criminal or? I suppose another FFL could take possession and sell for them out of state depending on the exact situation.

                            Just simply a person is closing their FFL and no one wants to buy the off roster gun.


                            For example, lets say I'm closing my FFL and have have an off roster gun which no one wants to buy.
                            Would the gun have to be forfeited to the government, destroyed, or what?

                              As others have said, selling out of state is a main option. Particularly if it's off roster, as most other states don't have a roster to deal with.
